Myparkingcharge. Parking on Railway Car Park

    What's this?



    On the 5th of Feb the driver parked in my local free train Car Park in a space big enough for the car but not designated as a car space when the driver returned they had a paper My Parking Charge notice left on the car.



    The penalty notice came on the 16th saying if i paid now it was 60.00.

    Could people please tell me the next step?

    To clarify it is a car park subject to railway bylaws
    The charge is from parking eye not indigo
    There is clear signage.
    The letter demanding payment came 11 days after the paper "this is not a parking charge" paper slip was left on the car

    I have never seen a myparkingcharge from Parking Lie.

    It would be useful if we could see both redacted documents please, the NTD that is not a NTD left on the car and the NTK.

    It'll be VCS and 'myparkingcharge' cases are covered in the NEWBIES thread. Firstly in the Q&A near the start, and then in the defences in the second post, there is one written for VCS 'not a parking charge' cases. Please read the sticky thread first.

    It does not time out after 6 months and they are likely to sue.

    However after reading the stickies im confused how to defend the parking charge as the template mentions lack of clear signage and other issues

    The car was parked outside hatched parking spaces and they have picture of this along with evidence of clear signage advising that cars will be fined if they do this.

    The station is free parking and is subject to the railway bylaws

    I have no idea how to defend this

    You'd be defending it the same as the other VCS railway claim threads.

    Partly based on 'no keeper liability' because it's byelaws land where a contract cannot fall under the POFA 2012 as it's not 'relevant land'. Only a known driver can be held liable, hence why the template appeal doesn't give away the driver!

    ...and partly on the fact that parking firms can't fine people for parking in a no parking spot, because they can't have created a contract to let the driver do the very thing that they are prohibiting.

    Only a landowner could pursue a person for trespass/parking where prohibited, and even then only if there was a loss caused. NOT a parking firm pretend that an agreed contract allowed that parking!

    You can't have a sign saying 'no parking here' on the one hand, yet also try to paint it as a contract, not without cleverer wording than VCS can manage.

    I just paid the fine. I was worried reading other threads I didn't want a ccj or court proceedings

    There was clear signage. They had plenty of pictures of me parking outside the hatched area. It wasn't indigo but it was subject to railway bylaws

    I couldn't find any information that made me feel confident in continuing not to pay the fine
    But if ever I stray from the path I follow
