Default Dates Re Failed IVA

I had an IVA which started in June 2014. My IVA then failed between 1 - 2 years later..

Question is, should all of my creditors reported def Default date of June 2014 to match up with the commencement of the IVA?

The reason for my question is I have creditors from my IVA that have no Default dates reported when I commenced the IVA or during my active IVA and suddenly then reported random new default dates in the years afterwards with the latest one being 2017? During the IVA their statuses show as Late Payment, Debt Management Plan or other things.

  • No, our IVA failed therefore you do not get any of the protection of an IVA/completed IVA.

    As you did not complete the IVA the repayment you set up and they agreed failed so they are within their rights to default you when they wish to. IF they defaulted you before the IVA and this wasn't rectified then they are not able to default you again, however if no default was ever registered then they are able to default you at a later date.
