Parking Eye PCN 24th August 2018

I received a PCN on 30/08/18 from Parking Eye and I have been through the process of appealing to Parking Eye and POPLA both of which were rejected and then I received a LBCCC letter on 28th November '18.
I responded to that letter on 17th December (letter said I had 30 days to respond) following the suggested template stating their letter was not fully compliant with the Practice Direction etc.and I have just received a reply today (5th February) dated 31st January '19 confirming "that we have received your response to our letter Before County Court Claim and that we will respond within 30 days of receipt. Please note your Parking Charge has been placed on hold"
They have taken 45 days to respond to my letter (I thought they had given up on it) but say they will respond within 30 days of receipt !! they have missed this by 15 days !
Are they entitled to take that long to reply and if so how should I respond ?

    they can take as long as they like , so do nothing, do not poke a sleeping mutt with a sharp stick


    whilst waiting , look at their site and see what the status says on your pcn reference, in case it says its zero and has been cancelled

    What happened when you complained to the landowner BEFORE trying POPLA?

  • I have now received what appears to be a standard letter stating:
    With regard to Annex A of the Practice Direction (Pre-Action Conduct and Protocols) please note that the same is no longer in force and that amendments were made to this Practice direction as of 6th April 2015. A full copy can be found here and gives a link.
    Notwithstanding the above, we ask you to note that the Letter Before Claim you have received has instead been issued in line with the new Pre-Action Protocol for Debt Claims. We wish to further reassure you that the letter you received is fully compliant with the same and that the Reply Form and Information Sheet enclosed alongside the letter are as prescribed by the Ministry of Justice.
    It then goes on to say the £100.00 remains outstanding and I have 14 days to respond otherwise they are prepared to take legal action etc.etc.

    Is there a suitable response to this or just ignore it and wait to see if they pursue legal action ?

    By "the suggested template" you mentioned above, did you send the REALLY ANCIENT one that talked about Annex A? Becuase that appears NOWHERE In the newbies thread...

    If you DONT send a repsonse, you WILL be taken to court.

    Did you contact thelandowner, as C-M told you you should have done, or twigged that you should NOW do this?

    OP, have you derived your forum username from your real name?

    If so, you would be wise to get your forum username changed to something very much more anonymous.

    To help with that, you might like to read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:
    Q. How can I change my username?

    A.
    In most circumstances, this is not permitted.

    The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.

    If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.
  • I used a template from zzzLazyDaisy for my response to LBCCC
  • I did not contact the Landowner before appealing to POPLA as I was not aware that was a step recommended and also I was not aware who the landowner is.
