Before submitting your defence, you need to edit it to remove the aberrations that were left over from a Forum glitch last year.Defendant !!!8220; was the registered keeper and/or the driver of the vehicle(s)!!!8221;.0

The Claimant is put to strict proof that it has sufficient proprietary interest in the land, or that it has the necessary authorisation from the landowner to issue parking charge notices, and to pursue payment by means of litigation.
its basically legal speak but means they have to prove either that they own the land, or lease the land from a landowner , plus have the legal right to pursue charges on the land, especially through court
for example, if the vehicle was parked at BUCK PALACE, they definitely dont own it so where is the contract allowing them to monitpr parking , to charge for parking , plus the permission from the landowner to take people to court ?
I believe its called words like "legal standing" etc , ie:- locus standi
ie:- prove to a judge that you the claimant have the legal right to be doing all of this from the parking issue right through to having permission to pursue people through the courts0 -
proprietary is easy to Google. This isn't hard to understand!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,
So I received a letter 28/3/19 from bw legal, saying "our client intends to continue with the claim, we confirm that we have notified the Court of the same". I will start on my witness statement now.
However, I received my Directions Questionnaire a few weeks back, I put down and to be honest I completely forgot about it!! I have come to fill it in and send back as soon as possible, but I seem to have misplaced the letter.
I have found the form online to print and fill in. Do I sent this to Northampton Court? Just putting a short cover letter at the beginning.
Thanks, Michelle0 -
Post #6 above tells you where you can find a blank DQ.
Hint: fill it in online before printing it - much neater.
Send your completed DQ to the CCBC in the same manner and to the same email address that you sent your Defence.
Again, re-read post #6 above to refresh your memory.
Remember to send a copy to the Claimant - address on your Claim Form.
There is a deadline for filing your DQ. Let's hope you haven't missed it.0 -
Make sure you email it to the CCBCAQ email and to BW Legal tonight, no posting.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi all,
A bit of an update with my case. After filing my directions questionnaire, it has now been transferred to my local court.
I have now received a letter saying;
The judge has considered the statements of case and directions questionnaire filed and allocated the claim to the small claims track.
Unless the claimant does by 4.00pm on the 22 July 2019 pay to the court the trial fee of £25.00 or file a properly completed application (i.e one which provides all the required information in the manner requested) for help with fees, then the claim will be struck out with effect from 22 July 2019 without further order and, unless the court orders otherwise, you will also be liable for the costs which the defendant has incurred.
It then goes on to state the hearing of the claim time, date, place etc.
So just to clarify, does this mean I need to submit my witness statement by the 22 July 2019?
Thanks,
Michelle0 -
No it does not.michelle95 wrote: »So just to clarify, does this mean I need to submit my witness statement by the 22 July 2019?
Is there not a sentence something like this on that letter?...Each party must deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than [ . . . ] [14 days before the hearing].0 -
Ok, yes I have re-read the letter and it does.0
