Car Tax refund

Hi All,
I sold my car on 8th September 2018 to a motor dealer.
I had a direct debit set up for the car tax.
DVLA continued to take the money until I noticed in January.
At this point I gave all details online.
Would I be due a refund for the months in between or can I claim it back through DD indemnity?

Called DVLA.
They said that they won't automatically do a refund as they were informed on 2nd January.
They said I could a dispute in with them by writing. I said could I claim by DD indemnity and she said "I can't see why not".
I assume that this is ok to ask for the money back?

Send a copy of the yellow slip on the V5C and confirm the date of sale.
Did you notify the DVLA at the time that you have sold your vehicle?0 -

The motor company I sold it to said they would do that.
They couldn't do it immediately due to myself transferring the private number plate.
The DVLA are aware that it was sold but only found on in January and not within September which the motor company should have done.
I'm not blaming the DVLA but they shouldn't be entitled to the money - or is my thinking wrong?0 -

but if you didnt tell them, and the trader didnt - and you aren't blaming them - then why shouldnt they be entitled to it? as far as they knew you still owned the car.0 -

You should have put the plate on retention (you can do it online) and you’d have had the new V5C a few days later. You could then have done the transfer online.
I recently did the same. It was easy and only took about 3 working days.0 -
So the trader sold it onto a punter who didnt fill in the V5 and pay the VED in their name when they sold it?
I would of thought that you would be able to get a refund as soon as the new owner paid the VED if you write and ask - as the DVLA would of had 2 lots of VED. Dont ask dont get.0 -

It's your legal responsibility to notify when you cease to be the keeper. Not the buyer's. You can do it online, it takes seconds.
You didn't do that, so were the keeper - and responsible for taxing it - until DVLA were notified of a new keeper in January.
Given that you sold it to a motor trader, you should have sent the "motor trade" slip to DVLA (or done it online), which would have triggered the tax refund and DD cancellation. The rest of the keeper change is then done when the trader sells it to the new "proper" keeper. I suspect that's what happened in January, which finally triggered the refund.
DVLA haven't done anything wrong. The trader should have done the slip, but forgot. Ultimately, it was your job.
Without that being done, DVLA perfectly correctly continued to take the monthly DDs that you'd authorised.0 -
