Hello,
I really need some advice please! First time iv ever posted in a forum.
I was living on a caravan site for 3 years, i lived in a tourer at first but then i used all my savings brought a static off someone on site in the new year. I have 3 kids so it was a great opportunity and a good start to the new year. Just recently found out that the pub, site, cottage, house, loads of other land are in the process of repossession and to be sold at auction (the receivers have already managed to get the keys to the cottage on the site). I was told by the receivers that i was not to pay any money to the landlady towards rent for the year untill the site was taken over by new owners. I dont have a written agreement. The receivers posted a letter on the door saying she still has a duty of care towards the residents living on site (untill they try and get the keys off her) and that she cannot remove anyone without written notice or a court order. She could not handle the fact that she's loseing everything she owns and the bank is taking everything and selling to pay her debts off, so she's run off and got a family member to come on site with backup and demand rent money off everyone or their off and told me that my static caravan that i just brought and serveal other caravans owned by other people on there are to old and need to be taken off (mine is only 20 years old). I told them everything the receivers said to me and gave them their number, they didnt want to know and started threating me. I argued with them, im not paying rent like i was told and my caravan isnt going anywhere and told them to either give me notice to get off or go get a court order. I came back a few days later to see my static had been dragged off of site and onto the side of the road half in a farmers field, all cables had been cut, personal belongs smashed inside, they had broke in through the skylight becuse they had left it open. I called the police, they were a waste of time said it was a civel matter and where on their side and laughed at me, not even going to do them for criminal damage. Found out later that they have the police in their pockets as its a small town and they all know eachother. I have know idea what to do, where i stand? Are they really allowed to do this and get away with it?

Ohh i forgot i had 3 sheds full of stuff washing machine, tumble dryer, gardening tools, tools, toys, bikes, aframe ect, they took it all its all gone, police said they cant do them for theft as i didnt see them take it. I had a uninsured car parked next to my static as its on private property, it was in the process of being fixed. That was dragged off site too and put next to the static on the road, it was towed by police and now im getting done for it being uninsured0

What a nasty situation to be in.
Given your landlady is broke, suing her for the damage to your caravan and the loss of your property is unlikely to be a fruitful action. You could talk to the receiver to see if there is anyway they would prioritise a claim from you over the businesses that are owed money. I very much doubt it, but it would be sensible to rule this out first. (I'm clutching at straws here).
Shelter should be able to advice you about getting rehomed. The local council should be able to help to some degree, but you will need evidence that your static caravan has been trashed beyond economic repair - if you had some money, could the caravan be moved to a new site (anywhere) and the damage repaired, or is only fit for the scrapheap now?
I understand the Police have appeared to be on the side of the criminals here, but they know that without hard evidence of who has committed the crimes, it is a waste of their time to investigate. You should check to see what evidence that could be used to convict the people responsible for the damage might be available, from any source. If you take hard evidence to the police and they don't act, you need to make a complaint, perhaps to your MP as police corruption is not going to get sorted via a complaint to the corrupt police force.
So sorry you have had this happen - there are some nasty people about. Take care. The comments I post are my personal opinion. While I try to check everything is correct before posting, I can and do make mistakes, so always try to check official information sources before relying on my posts.0 -
You need to get specialist advice.
Forget the theft aspect, this is illegal eviction and harassment - which the police should get involved with.0 -
Regarding your prosecution for lack of insurance on your car. The easiest, quickest, and cheapest solution is to pay the fine and send the car to the scrap yard. You will recover about the cost of the fine if you do this. Fixing the car will cost money, as will finding somewhere to store it. There are plenty of good old cars around, so you can always find something to buy when you get sorted.
You could go to court, and ask for leniency, but there is no guarantee that court would do so, so it will be much better for your sanity to write the car off.The comments I post are my personal opinion. Sort yourself some housing and speak to the council.
The 20 year thing is a rule on some sites, but not all. Have you checked the paperwork to see if they are making up rules as they go along? If the van is too old for the site then that begs the question of why the previous owner sold it to you/ whether you have been scammed.
Unfortunately static caravan parks get away with murder. (I own a van, but not to live in.) I have dealt with issues by threatening to go to Trading Standards, but it sounds like these people are beyond the point of taking any notice.
I am not sure you will be able to do anything with the van. Moving a van costs more than buying one and if it's old it might not withstand the journey anyway.
Speak to the council, speak to the other owners, and most importantly, speak to the person who sold you the van.0 -
