MOT Nightmare

At the beginning of January I put my car in for an MOT and when I took it back the next day it was parked in the dark. When I went to get petrol I noticed a number of scratches. I took it back and the garage said they would repair it. Since then, one of the door latches has broken, there have been further scratches and the exhaust was broken.

How can I claim compensation and how much should I expect/ask for?

Thank you!

You should expect your car to be fixed, not get compensation.

You can try getting it fixed elsewhere and then take the original garage to small claims court. But there is a significant chance you will lose the case.

You can't get compensation for a broken door latch unless they had removed it when repairing the door and most certainly can't for a broken exhaust because nothing they've done will have caused that.

When did the further scratches happen, between you dropping it off for them to repair and picking it up or afterwards?

  • 1. Ask the garage to fix the damage, or to pay for the repair if you want to take it somewhere else. Keep in mind though that you have a legal obligation to minimize costs so keep it reasonable.

    2. If they don't want to use Small Claims Court, then get it done yourself.
