DVLA SUBJECT ACCESS REQUESTS
You should email the DVLA and ask which organisations (and for what reason) accessed the registered keeper's data from them between a range of dates which includes the date(s) of the parking incident(s). You need to provide the registered keeper's full name and address, the address on the V5C logbook and the Vehicle Registration Mark of the vehicle involved in the parking incident.

Thank you so much much every one for the valuable advice. For your information my child had a further 2 debt recovery letters arrive just after the first. All 3 are alleging parking offenses within days apart some 10 months ago. All addressed incorrectly, all showing his birth year were the house number should be, no post town, the county 3 times and someone has written our house number on all 3 in biro.
Now my child openly admits to picking up one or two parking tickets on their university campus for which we received NTK at our home address and promptly paid last year, but these latest letters are a mystery as my child quit university and moved back home last May and the car has always been registered to our home address.
Once again thank you and ill certainly keep you all updated on our progress.0 -
has contact been made with the DVLA asking who asked for info , in a period starting a few days before the first (recent) incident and the fates the letters were received0

Yes i have just emailed DVLA literally 5 minutes ago.
Im now going to write to the ppc and complain to the BPA0 -
await reply from dvla , await reply with ammo that could get PPC sanctioned by BPA and DVLA0

Just a quick update on my post, as of yet I have still not heard from DVLA but I did receive a reply from First Parking LLP.
They said they acknowledge my sons letter but have failed to respond to give him a verification code to appeal. They have also failed to respond to our SAR.
All as they have mentioned is quote POFA 2012 stating that my son has failed to name the driver, blah blah blah and that we have 28 days from this letter to pay National Debt Collections.
They go on to say that "you have failed to provide the name and serviceable address within the required time frame, we had no option but to invoke keeper liability"
Well if they'd bothered to get my son's address right in the first place we may of heard about this matter in the required time frame!
I have also sent a complaint to BPA but that was only this week so im still waiting to hear from them.
If I dont get this matter resolved with the BPA's response is there anything else I can do or do we just have to sit and wait for a court hearing?

Reply in your son's name (these replies are coming to him as keeper, yes?) and tell them the only failure was theirs, given that a keeper has no lawful obligation to give driver details to a firm like them, so cannot be said to have 'failed'.
Tell them you have complained about them to the BPA, as they know they used the wrong address for the supposed PCN and thus, there was never any chance for the keeper to appeal earlier and they have certainly 'failed' the keeper and denied him a POPLA code.
Finally, state that you are surprised they say they can invoke keeper liability under the POFA, given that they know the NTK was never served, which fails Schedule 4 paragraph 9 immediately. If they believe otherwise then under the PAP for Debt Claims, you require F1rst to state in writing whether they believe they have fully complied with the POFA and to attach a copy of the supposed PCN they are relying upon.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
