Parking fine (Indigo/ZZPS)

Hi,

i received a parking fine at Station Car Park (Berwick) from Indigo parking for £60 for not displaying a ticket, however i pay using the indigo parking app. On this current day, i tried to pay on the train into work, but it wouldn't allow me, coming up with an error every time i tried to pay.

I put in an appeal by email, to which i didnt receive any reply. i then received letters that it had been passed on to ZZPS to collect the so called debt. I wrote a letter stating my appeal which they declined because it wasnt within the 28 day appeal period (even though my email was within that time frame) and any further correspondance would have to be with ZZPS.

ZZPS now say this fine is £170.

Could you give me any clarification on whether i have to pay this fine?

    You have not received a fine. If the car park is covered by railway byelaws (please confirm this) then this will time out after 6 months.

    Since your appeal has been rejected you are now in ignore mode.
    Debt collectors have no powers and can be ignored anyway. Post 4 of the NEWBIES explains why it is safe to ignore debt collectors. The rest of the NEWBIES tells you all about this unregulated scam and how to deal with it.

    After 6 months is up, write to Indigo (assuming byelaws apply) and tell them since it is statute barred they must delete all your personal data.

    Send them a SAR a month or two after this period to ensure they have done so. If they have kept your data then complain to the ICO.

    Whatever else you do, please complain to your MP about this unregulated scam.

    The NEWBIES thread already clarifies about Indigo railway fake penalties, and the 4th post of that sticky thread also clarifies about 'ignore the debt collector' stage.

    Not sure what else you need to know that's not already in the sticky thread.

    The only query I had, as Berwick is up North, you don't live in Scotland, do you?

    This is not a fine, it is an invoice for the damage they allege you inflicted on them when, by failing to pay, you allegedly breached an alleged contract, we know this as a scam. Complain to your MP.

    The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    why not ask them for a code to appeal to ITAL the new independent:rotfl: adjudicator :rotfl::rotfl:

    Berwick is also a small village to the West of Eastbourne, with a station operated by GTR.
