company being fraudulent regarding returns?!

Hi all,
I'm looking for some advice...
I bought a bridesmaid dress in December, in January I intended to buy another of the bridesmaid dresses, however by that point they had sold out in that size.

I contacted the company to see if I could still return the dress as it was over the 14day period, and they confirmed that it would be okay.

Upon returning the dress I received an email from them saying that there was a stain on the shoulder of the dress, and therefore they could only issue a credit note for the store. I queried the stain, as the dress was only taken out of the packaging but never tried on. They sent a photo of what looked like a glue stain on the collarbone area of the dress. On their website it says that if it is not in a condition for resell they will send it back. I asked for the dress back, as I didn't intend to spend any further money with them.

I decided I would sell the dress on eBay - and so when it arrived this morning I thoroughly checked it to ensure that I could get the stain out/it would be fit for selling. I noticed that one of the folds of the dress had a cat hair on it (any cat owners will know that cat hairs get absolutely everywhere) and so I knew that it was the dress I had originally sent back.
I couldn't find the stain anywhere, and sent a photo to my friend, who spotted that actually the pattern was totally different on my dress from the dress with the stain.
It appears that the company has lied and sent me a photo of a different dress, to ensure that they don't have to refund me the money.
What are my rights here, and how far can I take this?

    So you knew it was the dress you sent back because it had a cat hair on it? But you said you it was only taken out the packaging fine, but it was left to let the cat run all over it.


    Would you want to buy a dress in that condition? It's not a bad thing that some other poor bridesmaid isn't getting this dress.

    You do like to exaggerate a bit don't you.
    Who said that the cat had "run all over it" The OP stated that there a cat hair on it and if the company wanted to refuse to accept the return because of this, why didn't they simply say so?

    Are you saying that you think it's okay for the company to lie and commit fraud by using a photograph of an entirely different item in order to avoid having to refund?
  • have you tried to raise it with the shop again?


    Perhaps take the stance that perhaps they had made a mistake - and the photo of the dress photoed didn't match the dress you had returned - and perhaps an admin error had been made (blatently not - but pretend)


    Raise their awareness you are onto them and ask them how theyd like to proceed.


    Perhaps drop in that you have several photos for comparison purposes.

    I think this is a good way to go - I've sent a photo of the dresses side by side, and left my email open ended to see what they come back with?

    Having a quick glance over some of your other replies, it appears you are quick to take an aggressive stand point against those posting. Please consider the feelings and intentions of those who are simply posting for advice, not opinions.
