Not obliged to return items

The seller told me to keep the item!!!
So why the hell would i send i back?
So you’ve completely changed your story now?
Not once in any post before this have you said that, and it’s quite apparent from the seller’s email you posted that he wanted it back.
Looks like you just wanted some justification for your sleazy actions. Maybe the seller was right in his email, you engineered a dispute and never had any intention of actually returning the item, did you?
How many times have you had a refund from a dispute and then kept the item after getting the refund?
I hope karma comes around and meets you head on one day...====0 -
If eBay told you you don't need to return the item then you don't have to. But of course the right thing to do is to return it. The seller can technically take you to a small claims court to have you return it. I would have the seller pay for the return shipping and return it. Fair is fair you have your money back.0

You seem so fixated on trying to prove the OP wrong that you are not actually understanding what they have written.
When they were referring to a seller telling them that they didn't have to return goods for which they had been refunded, they were not writing about the item that this thread is about but a previous purchase. The point is ive kept items in the past that ive been refunded for,.The seller told me to keep the item!!!0 -
If the seller has told you to keep the item then it isn't even an issue, you keep the item, no problems there.
If he has asked you to return it and he will pay the return postage, then for me personally I would return it, despite what ebay claim is right.
Put yourself in his shoes, say you sell a £400 laptop, for some reason there is an issue and they file an item not as described, you don't have an access to a PC for some reason or another, maybe you have gone on holiday. They get their money back and you lose the item, how is that fair?
However as you have said the seller told you to keep the item and was in full communication with you, then you have nothing to worry about.0 -

You have confused the issue. Maybe you need to read all the posts, he is replying to a post I made relating to the current seller and his second quote you posted relates to the current item, you haven’t followed the discussion if you think otherwise, he’s posted up an email earlier where the current seller has asked for the item back and he’s refused.
Go back to post 30 and 31 and you’ll see that you’ve got it wrong.====0 -

Same to you.
And yes ive kept items after refund just a few times, these are low value items and proved they were faulty etc.. and for seller it doesnt make sense to pay to return it.
You seem disgrutal like the seller, you simply dont get it and other people do. YES the seller did say he wanted the item back as in the message I quoted but the thing is this is AFTER I contacted him several times and AFTER ebay said you dont have to return.
read the thread again or just leave it at that as you dont have any positive inputHi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -

Then stop trying to weasel out of sending it back, tell the seller to pay the postage (or send you a postage label) and do the right and moral thing, send the laptop back to its rightful owner, it’s not yours...====0 -
Thats the point..
eBay said DONT contact the seller, they have to contact you AND give you a retrun postage label. If they dont you are NOT obliged to return the item. If thats ebay policy then thats what you should do because you bought it on ebay.
So after I agreed with ebay to return the item and went out my way to contact the seller (he didnt contact me) this is what he replied:
“Actually that has already been done and actingion taken by ebay to both discipline the staff involved as well as a log kept on the the FACT that it is in EBay own policy that ANY change to the actual operating system version itself on ANY form of device be it laptop deksotp or even mobile phone constitutes a change in the condition the product was received.
You will find not only is this clear verifiable, but it is also the dame policy employed by PayPal (whom have also confirmed this). Not exactly surprising considering the UK Law takes the same view.
The fact you neothe rknew this and even now refuse to acknowledge this even though it is evidentialy provable. Is not entirely surprising give that you did not even know that Windows is and has been 64 bits for years and no major device other than very small underpowered one may come with anything less.
Yet claim to know about Windows licensing an dother apsects better than us who have decades of expertise in the field.
I have clarified to you already in CLEAR terms that Ebay have closed the matter from there side and effe ticely washed there hands of it.
The fact the money has been reimbursed to you closes the matter form there side as the have fulfilled there obligations to you.
The fact you are refusing to accept this and want to retain the goods and have have the audacity to try and insinuate that reporting it to the police. Given that you are in possession of goods not paid for. Is beyond comprehensible.
It is as suspected that you set out to misuse the eBay system and abuse your buyer rights. It is behaviour such as this that costs honest sellers who work hard time and money as well as ebay.
You never had any intention of returning the laptop and obviously are taking advantage of ebay and myself. As you knew that there is no way to enforce a returns now that eBay have closed the case and concluded it. Yet insist on only returning it IF I can do that which is impossible.”
wrongful accusations, contradictions, unprofessional, difficult to read english and comes across as disgruntal in nature. Oh and this guy thinks he knows better than everyone, he even went as far as trying to get ebay supervisors and support team 'disciplined' for ruling against him, seriously?
Assuming that the quoted text actually came from the seller, I can not see any mention in it where he mentions that he wants the item back.
You wrote that you "agreed with ebay to return the item and went out my way to contact the seller "
Why did you do that, especially as you go on to mention "he didnt contact me"0 -
The only time I've not returned something was when the seller tried to openly and obviously scam me. eBay sided with me. He tried to scam me again. I didn't bite. Kept the item and got it fixed under warranty.
Absolute mug. Should have just been honest.... or claimed on the warranty?0
