I have been awarded ctc but they didnt backdate to when my daughter was born-for some strange reason they worked from when she was 2 months old...anyway i have rang and rang and rang and it has been escalated but after 2 escalation attempts still nothing. i asked to put in a formal complaint and they said a supervisor/team leader would call me within 3 days. that was 5 days ago. im fuming as i am due over £500 and i REALLY need the money. what should i do?

How long after she was born did you apply? Perhaps they only back date a certain amount of time.0

I have checkedt his and they said there was no problem witht he backdating as it would go back to when she was born anyway. It was probably when she was 10 weeks old that i applied. it all went thru swimmingly till i asked where the backdated money was!0

the time limit for backdating is 3 months
i would be back on the phone ,asking where they got their dates from.

Hello milliesmama,
The reason I asked if you were on benefits was because if a customer applies for tax credits their claim is automatically backdated 3 months from the date received (subject to eligibility & entitlement). However, if you complete a form and indicate you are receiviong one of the following; Income Support, Jobseekers Allowance (Income Based) or Pension Credits, for some reason the system will only backdate your claim from the date received. It doesn't mean your not entitled to the money it just means a refferal has to be sent to the backdating team to issue a giro cheque for the missing amount of backdate. This can be done by telephoning the helpline and asking them to send the refferal. Clearly the advisor(s) not doing their job properly. I would advise you wait for your callback and request the team leader to do this for you. Also, if they say they are going to do a "manual workaround" themselves tell them not to bother and request the refferal. Hope this helps and let me know how you get on.

Ps, all the above is on my asumption of the IS marker, their could be other factors but the above is the most common.0 -
Hi
I was wondering if anyone could help. When my daughter was born (Oct 06) I didn't tell the tax credit people immediately as I have previously been overpaid by them and didn't want to get into the situation where I owed them money again. So, I waited for the end of year review then phoned with all my final figures (in June 07). They will only backdate her birth to March 07 (3 months). I have appealed but they say it is 'unlawful' for them to backdate it more than 3 months. I have requested an oral tribunal but was wondering if anyone has experience of having a claim backdated more than 3 months. My colleague had hers backdated more than 3 months when she and her husband split up and was told she just had to write a letter. Does anyone know the legal position or have any experience which I could use in my appeal?
THANKS A MILLION!!0 -

Thank you so much for this post! My baby was born at the beginning of October and after reading your post I checked my award notice - 3 weeks have been missed (obviously due to my IS) and after calling them they said they will issue a new notice and the the owing amount.
Thanks again!0 -
