This one I suspect, but from reading it the case is still ongoing in the tribunal system.

There's no decision been made yet, it's all still ongoing.
  • Doesn’t matter which one you work for at the moment, think they said I final decision would be expected by May.

There are three stages to an equal pay claim. This appeal only related to the first one. Asda have actually said that they will seek to appeal this decision to the Supreme Court, but even if they aren't successful with that, there are two more stages to the equal pay claim itself before it'll be determined whether or not anyone is owed money.

Surely if they lose at the final final final stage, whenever that is, then they would automatically pay any staff still working for them automatically?

I hope the OP has joined a union, because that would definitely help if they're daft enough NOT to pay automatically, IMO.

Pay what, though? These cases are never actually about equal pay for equal work, companies pretty much all do that anyway. What they tend to be about is that someone has decreed that working on the checkouts is equivalent to doing the midnight to four a.m. shift cleaning out the mincing machines and so decided that the pay should be equal.

The work, of course, is never equal.

It’s like when it is claimed that working on the bin lorries is “equivalent” to being a dinner lady or that scrubbing out septic tanks is equivalent to polishing the floor in a school.

Can't believe the claim has got this far. It's a complete scam by money chasing solicitors.

They will pay out if the law tells them to pay out and currently that is not the case.
