  • Thanks for this - is it all okay then?
    Should I put something in about ignoring letters as they were thought to be junk mail?
    Also I requested a SAR on 17th Jan, but will not be able to use anything that they send me as it is unlikely to arrive in time - should I be concerned about this?

    IANAL but it looks OK to me (based on reading other defences). You should add in only points of law/technicality and only those that help you. If the SAR data comes back within it's requisite time frame (one month) possibly the Witness Statement (WS) is the place to refer to anything that helps you. You cannot, of course, add to the defence but a well crafted WS can work wonders.

    as you will be aware of, from readin POST TWO of the newbies thread, at your WItness Statement stage you add evidence that suppotrts your arguments that you are not liable.
  • So I received an email from Britannia yesterday re my SAR (which was sent on 17/1) asking for my number plate, PCN number & address saying the only information they have to go by is my surname and that the returned results are too large to narrow it down without the extra information! This is despite me sending my full name & address with the SAR.
    They also say the one month to provide the info starts from when they receive this information. Is this correct? Should I reply and say they should have been able to find it with the info I already provided?

    I would have given them the PCN number and VRN anyway, so yes, supply that info.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
