Unable to re-claim Capital One ppi

My husband and I made a few PPI claims a few years ago (some where successful and some weren’t) - two of them were for the refund of PPI on our Capital One credit cards. These were refused.
I thought I’d seen somewhere that you can now claim again if you’d been refused before, so I tried Capital One again and was told ‘Under the rules set by the Financial Conduct Authority, consumers only have the right to complain about the sale of a policy once’.
I’m a little confused, as I though I’d heard it was now possible to do so. Can anyone advise me please?

  • Take a look at the Plevin rule. Did you mention this in your second complaint to the bank?

    Nope. Once refused, the firm can refer you back to their original decision. However, they are required to check with the Plevin rule applies.

    The Bank have issued the terse repeat of their earlier response because their original reasons for rejection still apply and Plevin (which they are obliged to check if you "complain" again) clearly also does not apply to you.
