Elite Management (Midlands) Ltd - PCN

I wasn't involved in this thread, but its the original one where I myself noticed Elite Management (Midlands) Ltd were suspended from BPA after getting a PCN recently. I wanted to find out a bit more so contacted BPA, and the reply I got confirms the above (reply received 20/03/19):
“Are Elite Management (Midlands) Ltd members of the BPA?
I can confirm Management (Midlands) Ltd are members; however, their membership benefits have been suspended.
“Do they still have access to DVLA records?”
They cannot make keeper requests from the DVLA.
“If they are reinstated as members, will that give them the power to request DVLA details of people issued PCNs whilst they were suspended?”
Should Elite Management (Midlands) Ltd have their suspension lifted, they will only be able to obtain keeper details for charges that occur after the suspension.
I also asked about why they were suspended and if they were going to be reinstated any time soon but they were unable/unwilling to answer those points.
This doesn't give us any more information but I thought I'd post it here in case people on this thread were waiting for updates.
So I'm right in thinking that without current membership, Elite cannot get my/our details from the DVLA and cannot issue a NTK?0 -
Hi,
am a newbie to the forum, so apologies if retreading old ground here.
My wife was issued a ticket from Elite Management (Midlands) on 27/04/18, which i understand was after and during their suspension.
We've had letters etc from them referencing her and the vehicle, which to be fair we'd ignored and stopped about 6 months ago (The originating offence is laughable), but received a new one from Gladstones branded 'letter before claim'.
If they've ticketed her and obtained her details whilst on suspension, does this just blow their claim away into an 'unlawful' category? (im hoping the case, but presumably they are allowed to obtain from other sources?).
thanks0 -

I am constantly amazed how newbies post on the forum without seeing and reading the sticky thread in capitals near the top. Anyway, my signature tells you where to click to read it. NOT the first post of it.

I got a ticket from them on the 2nd September despite paying for a 24hour ticket.
Basically they're saying it wasnt displayed correctly. (it was upside down)
Just seems massively unfair
Does anyone know if they still have their membership benefits revoked? Really hope so.
I have appealed with them and can only hope they see sense and come to the right decision.0 -

If they are still banned from getting DVLA data, and I haven't checked that, they had no way of legitimately finding out the keeper's name and address. By appealing, you have given them that information.
That aside, if you want to progress your issue further, you are best advised to start a new thread. Trying to progress the issues of two or more people in one thread can only lead to confusion.0 -

They still have no ability to access personal data from the DVLA. That was your shield, so have you not only lowered that, but offered your chin for a punch?
Please open your own thread for your personal case, not jump on someone else's.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
