    Is this because it's a roundabout, what if someone causes a collision when changing lanes on a dual carriageway, Is that always 50/50?
  • Have you given the photos to the police? If they at least show the location somehow and you can prove she drive off before stopping some distance away then it works in your favour as she broke the law.
  • It's not 50/50 if someone moves into your lane, especially if they come from your blind spot as it seems she did. It's only 50/50 if you should reasonably have seen and avoided the collision too, which in this case does not seem right.

    How's a dashcam going to help if someone drives in the side of you on a roundabout? Could just as easily be you cutting up the other driver. In these days of video editing is footage that is not independent even admisable as a defense?

    Photos will not show location as they were taken some distance away.

    Can you not safely photo the road layout at point of collision to show no merge point?

    From what you have written it sounds like 3rd party did not want to go on motorway but wanted to go round the roundabout to another exit, which is why 3rd party tried to push into your lane.

    If your damage photos are clear, try sending them to your insurer, they could well accept them as proof of 3rd party fault but make sure they nare labelled "my vehicle pic 1" etc and "3rd party vehicle pic 1" etc so there is no doubt.
