Hi,
i wondered if anyone could help, my hubby has been off sick for a year and yesterday let go from his job. We have been getting UC, we have had 2 payments since October, 1 at full amount due, 1 at £50 less due to my xmas bonus and then today received nothing again due to my xmas bonus. He is going to the job centre tomorrow and i assume he will be better on JSA, does anyone know how long that takes to be set up. JSA is more than we get in UC so will help us more but also he is due £400 ish holiday pay from his boss so will that make it that JSA will stop for a few weeks or does it not work like that.
Sorry we are clueless when it comes to this kind of thing. He is unable to work as a chef any more hence being let go (shattered foot so cant walk properly still using a walk stick, we had hoped his boss might keep his job open another few months) but could get a sit down job around school hours so hopefully the job centre can help him

Looking at your previous posts I am a little confused.
Did your husband make an application for contribution based ESA (new style ESA?) What happened to his claim?
He also applied for PIP? What happened with that?
Once you are on Universal Credit you cannot make a claim for JSA unless he was making class 1 NI contributions during the last two full tax years.
So, if he is eligible he could claim new style JSA but this would be treated as income for Universal Credit.
What are your circumstances? You seem to be working.
Do you have children? Rent?
Perhaps you could explain your circumstances a bit more.
It seems that your Christmas bonus was counted for two of your UC assessment months. Is this correct?0 -
Hi, yes we got passed from pillar to post in August between ESA, UC, New Style ESA then back to UC, Finally sorted and first payment end of November, basically he didn't work for 2 years whilst our daugther was young as i had a better job and supported us both so couldnt get the ESA. He hasn't heard from PIP but we doubt anything will come from that. He has then been working June 16 to Jan 18 when he was knocked off his bike.
I work full time, we are a 4yr old no childcare costs as at school, we have a mortgage.0 -
From what you have said it seems that he may not be eligible for new style ESA but might be worth applying.
In any case it really won't make a difference money wise as you are on Universal Credit and his JSA would be deducted from the UC.
As already said, you now have to stay on Universal Credit. Hopefully you will soon get back to some payments.
Have you both signed claimants commitments or are you exempt because of you full time work and hours?
Hopefully, too, he will be able to find a job that fits his injury and the school hours.0 -

If he applies for new style JSA they will look at NI contributions from April 2016 to March 2018. Depending on what he was earning he may meet the requirements even though he didn't work the whole of the year.
New style JSA is £73.10/week (for maximum six months) which is equivalent to £316.77/month. Unless your monthly UC payments are less than this you will be no better of if he claims JSA as the JSA will simply be deducted from the UC (as previously advised by pmlindyloo).Information I post is for England unless otherwise stated. hi our monthly UC is £211 so we would be better off on JSA if he can change to that. He has only missed maybe 5 months of NI in that period, 2 months ish before he went back to work in june 16 and 2.5 months before march being on ssp from 18th Jan 18.
Everytime he sends the job centre a sick note, our payment gets stopped as they say "oh we see you are now working" we then have to call each month to say no he isnt. Even yesterday he called them to say hes now unemployed and on his journal today said we have cancelled your telephone interview (not sure what it was for) as we believe you are now working and dont need our help...they are honestly a joke. He has a GP appointment tomorrow about his foot and then is going to the job centre for some advice.0 -

1. Must have paid or been credited with NI equivalent to 52 weeks in both years.

He has now been given another 8 week sick note and nerve tablets for complex regional pain syndrome so hes going to call them, not sure if he will be expected to still look for work whilst having a sick note x0

he happened to just get his PIP letter today with his assessment date aswell. Sorry couldnt figure out how to edit the post above. Doubt anything will come of it but its booked in now so he will go0

If his sickness is likely to be long term he should try new style ESA rather than new style JSA.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -
not to appear judgemental - and perhaps I am in need to education - but isn't JSA (Job Seekers Allowance)
If hes sick, long term - is he really going to be actively seeking a job?
Perhaps its semantics, but if you are in need to social assistance, surely there are other means?
People I know on JAS tell me that have to proved they are actively seeking work - so if my understanding is correct - that route of welfare my not be the correct one.0
