    The driver paid the parking fee late (it was eventually paid within the time period that the driver initially was supposed to pay for), however the driver did pay for that time period. The PCN does not mention this part at all though. The driver left the car park just over 10 minutes late.
    If you are saying the driver paid half an hour late (why?), AND left ten minutes late, then you cannot use grace periods at all.

    You mean the person paid for just one hour and stayed for, say 1hr 45 mins?

    You will not win this on appeal at POPLA unless you get lucky with ParkingEye dropping the ball on the landowner authority (if you ask for it at POPLA, as per our templates).

    Otherwise, unless this is what we call a 'Golden Ticket' - see NEWBIES THREAD and check! - you have no chance of winning this one on appeal.

    Any chance of complaining to the landowner as a first step, which has more success?

    The driver paid for it late because the driver just forgot.

    So for example: The driver originally was supposed to pay for 1 hour. Half an hour later after parking in the car park, the driver realised that the driver forgot to pay, so the driver paid (via mobile app). The driver stayed for 1 hour and 11 minutes.

    Technically yes.. but I'll explain it better. Sorry, I'm not being clear enough... apologies.

    For example:
    14:00 - Driver parked the car in the car park, only wanting to stay for 1 hour, and left the car there without paying.
    14:30 - Driver realised he forgot to pay, so he paid for 1 hour.
    15:10 - Drove out of the car park

    The PCN is not going by the hour from time of payment, but rather by the time of the driver arriving and departing the car park.

    as you say, you didnt explain it well enough

    the driver was ON SITE for one hour and ten minutes in total

    this means that they arrived and left within the stipulated grace periods

    however , the driver failed to pay promptly and this led to a pcn being issued, even though the driver has paid for the full one hour and left within the grace periods allowed by the BPA CoP , meaning the claimant suffered no loss as the parking period was fully paid for


    PARKING EYE do not measure parking time, they measure time on site

    the BPA CoP clause #13 provides the grace period times

    So, yes they did (effectively) leave 'early' as any printed receipt or PDT ticket would have said parking was OK until 15.30.

    So the alleged overstay is 10 -11 minutes (unproven and probably wrong as the ANPR cameras are not synchronised), so when you get your rejection letter, read and copy any ParkingEye Grace Periods POPLA appeal.
