Query on Land Registry language - does this mean what I think?

Thanks for reading, first of all.


Background - our neighbours put in for ownership of unregistered land adjacent to their own, but the land they were claiming also included a section which was adjacent to land bought from them by our predecessors here, so not next to their land at all. They were claiming they had used all the land for donkeys' years - but this bit had been sold 15 years ago, and they would have had to trespass on our land to get to one part of the land they were claiming.

We objected, and just before Christmas received a B193(O) which we sent back saying we would be willing to negotiate. I have now received a letter from the Land Registry saying 'the application has been cancelled on XXX date because the applicant did not respond to the B193 notice, indicating their intention to continue with the application.'


First read through I thought it meant that they had not responded, so the application to own the land had stopped. End of story. But second read-through I wondered whether that comma means they did not respond, and therefore they intend to continue with the application.


Which one is it, please?! Is the application over, or will there be more to come on this?

    Application cancelled is pretty easy to understand.

    I have been looking online and the options at this point in the process do not include that - which is why I was asking. It appears the applicant could withdraw the application, but I was puzzled by it saying cancelled in effect by inaction. Hence the question.


    Sorry for asking a dumb question - just wanted clarity.

    Land Registry send a Notice of Cancellation when the application they received did not provide the correct documents or other paperwork in order to carry out the transfer of ownership. The Land Registry will normally respond with a Requisition, which is a letter setting out why they cannot complete the application and they provide the steps needed in order to do so. There is usually a date on this letter by which the applicant should respond. Land Registry will issue a Cancellation Notice when the application is not acceptable at all, i.e. not enough information, wrong paperwork submitted or title plan not correct etc. If they have simply cancelled the application then what was submitted wasn't right. The applicant can re-submit the paperwork, but they would have to go through the process from the beginning again and pay a further fee.
