Ebay, Paypal and Click-and-Collect

Can I ask for thoughts on the following issue:

Now that ebay offers click-and-collect for private sellers, when a buyer uses it and pays by Paypal, what are the ramifications with regard to the Paypal dictat “You are only covered if you shipped to the Paypal registered address”, as we keep hearing on these and many other fora..

I have recently sold an item on Ebay, by auction, and the buyer chose C+C to an Argos store. I did all the usual print-postage-label-automagically from Ebay, without a second thought.
Turns out the guy was a scammer (he had scammed other sellers not just me), and tried to claim the item faulty. Ebay closed the case in my favour (long story short) and I kept the money. Ebay closed the buyer’s account. I did notice, before they closed it, that the buyer’s normal Ebay address was some 300 miles away from the Argos store he picked to collect from. Hmm.

Anyway, after a week of nothing, buyer opens a claim via Paypal, which is still ongoing. They of course have no interest in what happened over at Ebay, and I am just waiting for them to say I have no seller protection at Paypal because I didn’t ship the item to the Paypal Registered address.

Is this right? Should this happen? Are people aware of this? Do Ebay and Paypal know of this loophole between the two sets of rules?

- Ebay on the one hand saying “we recommend you pay by and accept Paypal, and yes offer click and collect too, its no problem, we’ll stand by you anyway” (which they actually did!) …

- Paypal on the other hand saying “erm… no. That’s against our terms and conditions. You have to ship to the buyer’s address only, otherwise we might give all your money away to anyone who shouts and stamps their foot”

Thoughts please anyone?

(I should add here that I have now disabled Click-and-collect on my Ebay auctions, but that doesn't help me in this case!)

  • Paypal seller protection is for sending the item to the address given on the payment, in the case of a click-and-collect, that is the Argos store. Did you send it tracked/signed or get proof of postage? If so this can be used to dispute the paypal claim.

As above, the only address that matters is the address that is given on the paypal payment and which says 'OK to send'. If that address is Argos then you are covered, if you ignored that address and sent it to their home address (and I'm not sure how you would pick that up anyway) then you would not be covered.

I would suggest you avoid other places if they are insisting on only a paypal registered address as they are so far out of date it is dangerous. About 15-18 years ago the rules said something like that but as buyers can have several addresses the rules became nonsensical (I have about 5 current addresses in paypal). I am shocked if other places are giving such terrible advice.

Just as an example, I used to send parcels to my sons at uni and had various addresses listed for them, all showed correctly as OK to send. The 'registered' address system no longer works and you would be hard pressed to see only that on any paypal notification.

@Gary... oh yes it was tracked, and anyway the buyer is not disputing that he got the item, he did... he says its "playing up" so the fact he got it is not in question. The thing I dispute is that he says it's "playing up". Now, it might be, but given it was a pristine condition iphone, and the fact that he has defrauded other ebay sellers (which is why Ebay closed his account) and the events in my case are running exactly according to the classically-known scam, means that I am pretty sure he intended me to be his latest victim. He doesn't answer any request for either further information, or for an address where the item can be collected by my courier. Now if he really wanted to return the iphone, he would have given some response

@Soolin... Thankyou I get exactly what you are saying and yes now I have checked, the Argos address is the "OK to Send" one that you mention.

I have come here because it seems the only place where I get people who know what they are talking about :)

I now must wait and see how Paypal find in my case. I've done everything right (I think).

Your danger here is that paypal will find for the buyer as they rarely do otherwise for SNAD claims, if you allow it to time out then paypal will refund the buyer.

Personally I would keep on at paypal, explain that you have already won an SNAD on ebay and use the same argument on paypal as you did on ebay as ebay are harder to persuade out of a SNAD claim than paypal!

Phone paypal, keep phoning, explain that you are being scammed and that you need a guarantee that your funds are safe. If they will not give a guarantee ask paypal what happens if buyer ships back a different item, get their response in writing and then accept the item back - on paypal buyer is obliged to return the item fully tracked at their own expense.
