Hi
I am starting a new thread as I am not getting a response from my original thread and this is now urgent. I hope this is ok.
My original thread is number 5930710 - I can't post links as a new user.
Further to a PCN from CEL I now have a set aside hearing court date for next week (in approx 10 days time). I understand that I need to show that i applied for the set aside promptly and that I have a good chance of defending the claim in court. This defence will be on the basis of 3 things:
1. CEL do not comply with POFA 2012 wording
2. The claim was defectively served using an old address
3. The court forms were not completed correctly and go against Civil Procedure Rules (I have only just found this out and this was not submitted in the original N244 form)
What I don't fully understand is how CEL don't comply with POFA 2012. I would like to completely understand this in case I am pressed on it. I now have copies of the paperwork from CEL and there appears to be wording relating to POFA 2012 on thePCN and reference to keeper on the pay slip of the PCN in the tiniest writing (1mm). Is this where is falls down, and if so in what way?
I am happy to post images of the PCN if it would help.
I would also like someone to direct me to where I can find DVLA FOI document that confirms PPCs were told they should/can use TRACE to check addresses.
Any help would be extremely gratefully received!

To edit the thread title, go into edit on your opening post.
Then click on Go Advanced.
Then type what you want in the Title box.
Might also be worth a reply on your other thread - something like "anyone offer help with this" - to bump it to the top of the list again.
You existing thread has already dropped to number 107 in the thread index list - on page six!!.0 -
