Britannia PCN at Waitrose

Options
Having received a PCN from Britannia with pics etc, I went to the Britannia website and the ‘appeal’ page. I submitted this exact appeal - ‘I refuse to pay this charge unless I can see the time stamps on the photographs of my car and you provide me with evidence of how you calibrate the time clocks on your cameras and how you synchronise the clocks between the cameras AND tell me how often this is checked?’
I received the reply by email - ‘Having considered the content of your letter and our internal review, we have cancelled this notice.’

They obviously did not fancy their chances at PoPLA/court. However, cancellation or not, they stili tried to scam you so complain to your MP.

The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
You never know how far you can go until you go too far.

    WOW well done Speedy Gonzales:j:T

Britannia did not have the information, of course not.

And the truth is, the BPA don't know either despite their witterings.

As said, they still tried to scam you

At least you won't get their legal jokers pestering you

  • Hi Guys

I must be doing something wrong.

Got a PCN in a Waitrose carpark, so read the Newbies thread etc and complained to the Customer Service staff at Waitrose, asked for the manager etc., was told they can't intervene, NOT INTERESTED!

I copied and pasted the standard denial of being the driver etc to Britannia and am awaiting their response, but as has been said already, is a means to getting a POPLA code.

I also read one guy on the forum recently sent Britannia this email "Further to my appeal against this parking charge notice, I refuse to pay this charge unless I can see the time stamps on the photographs of my car and you provide me with evidence of how you calibrate the time clocks on your cameras and how you synchronise the clocks between the cameras AND tell me how often this is checked". The poster of this got his cancelled by Britannia, but mine got this reply:

    "Good Afternoon,

Please see attached the time stamped photo’s of the vehicles entry and exit on the date of the contravention.

The ANPR cameras are monitored on a daily basis, both manually and through reporting software, to ensure they’re working at an optimum level for vehicle capture. The camera timings are synchronised using TARDIS which is an application that enables synchronisation between the cameras and time servers on the internet using the protocol NTP. It does this automatically, without intervention, and runs periodically, every 6 hours. Any variance from the internet server of more than 0.5 seconds is automatically corrected by TARDIS. Any downtime or maintenance issues are immediately highlighted via an automated process and resulting in the system being shut down for the required time period. On the day in question the cameras were subject to the regular checking procedure and were working at an optimum level.

    Please await your appeal response".

    Humph!

Why are you talking to the monkey, it's the organ grinder you need to be talking to.

You go to the MD and tell him you are not prepared to spend money when he has a car parking company that thrives on taking his customers to court. To retain your custom request the ticket is cancelled

    Hi Guys

Yep, you are, by hijackng someone else's thread as if they no longer matter in comparison to your case. Forum rules apply!

And have you checked this out to exhaustion? Or just accepted at face value? If the former, please tell us what it says. But on your own thread, please.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
