INDIGO Parking - Who's in the wrong?

A driver parked in an Indigo parking bay before getting on the train. The driver had decided to pay for their ticket by calling in. Due to phone service issues on the train, the driver only managed to pay for their ticket one hour after they had parked.

Upon returning to the vehicle, a PENALTY NOTICE was displayed on the car.

In this situation, should the driver appeal, stressing that Indigo have suffered any losses due to the fact that the driver paid? Is there anything else the driver should do rather than appealing?

Thank you very much in advance for the advice.

the driver would be a fool to do anything at all

the KEEPER is not liable as POFA2012 does not apply

so the KEEPER follows the advice in the NEWBIES FAQ sticky thread and appeals it accordingly, as KEEPER , once an NTK arrives in the post

we dont care who is in the right or wrong, neither does INDIGO

The advice you have been given is spot, there really are no IFs or Buts
  • as above , just to add , after you make an appeal , you will be offered a second appeal thru ITAL

Nope. Certainly not anything about 'no loss'.

Up to you if you try ITAL, which is so new it's not tested enough for us to know on what basis they might make their 'decisions'. You won't get POPLA.

NO-ONE pays these, not here. Fake railway parking fines time out after 6 months.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • if the answer from ITAL regarding displaying a ticket (app) is anything to go on ,,,,,,,,,,,,,,,,,,,,

"you are required to show your ticket to a ticket inspector when requested"

    the mind boggles ,,,,,,,,,,,,,,,,
