UKPC PCN Crawley Leisure Park

I have read the 'Newbies Post' but it can be a bit confusing, could you please clarify the following ater receiving a PCN for not parking in a marked bay, even though I thought it was a Space and was not obstructing anyone:
- I should first appeal to UKPC on the 26th day after the PCN was issued?
- I should request evidence, and full explanation of why it was issued?
- As this was a free car park, and I was not parked across bays or in fact a actual bay, or obstructing any roads, ask them how they are claiming for loss of earnings? if anything they earn more by freeing up a marked bay.
- Where there is signage stating you cannot park in the bay
-I should admit I'm the keeper of the vehicle but not acknowledge I was the driver?
- Once they acknowledge I'm appealing, and respond, I should then appeal to POPLA?
Is this all correct? Anything else I should add?

In fact, the whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -
Hi,
the Newbies' thread looks daunting at first but it's easy enough to find the blue template for appealing to the parking company. That is all you should do at this point, UKPC will not take a blind bit of notice of all your other points, reasonable as they may be. You appeal as the registered keeper, if that is who you are, and do not identify the driver. That last thing is so important that you should also edit your post so that the driver is not identified here. I don't think there's anything to gain by waiting till day 26.
You should also put in a complaint to the Crawley Leisure Park ASAP, not customer services or the like, but the manager at the very least.
And yes, when you get their (almost inevitable) refusal, you use the POPLA code to submit the POPLA appeal. It's at this stage that some of the points you raise will be used. Some, not all, plus others you've not mentioned. The POPLA section of the Newbies' thread should prove very useful as will reading other threads about UKPC. And if you want to start preparing, get some photos of the car park if possible, especially signage and bays / non-bays.0 -
First, edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper, who are two different people. Do this before you do anything else.

For a windscreen PCN, appeal around day 26 online.
For a postal PCN (NTK) appeal straight away unless byelaws apply.
Appeal using the ready made template in blue text from post 1 of the NEWBIES.
You ignore anything from the scammers asking questions about the identity of the driver.
If/when it is rejected you appeal to PoPLA.I married my cousin. I had to...I don't have a sister.
