ParkingEye Parking Charge Notice

Hi - I'm new here, and I started by reading through the stickys.

I received a ParkingEye parking charge notice this week - despite having paid in full for the amount of time that the car was parked (4 hours at a cost of £12 plus a 20p 'service' charge). The car departed from the carpark 1 minute before the ticket expired (which is shown on their photograph of the car departing).

As far as I can gather, they are attempting to charge for the time taken between driving into the carpark and buying the ticket (which is done using a convoluted, text message based system that took just under 10 minutes to complete). The carpark was not left during this time, and only one thing was achieved - buying the previously mentioned ticket.

It seems like this is pretty much set up to entrap people - surely this cannot be not legal?

I'm concerned about the charge - but I really cannot see they have any case to actually enforce a payment here, although any advice would be appreciated!

    Yes, it is set up to entrap people. As far as I know it is not illegal.

    Appeal to P.E. using the blue template on the Newbies' thread as it is, no changes. They will almost certainly refuse the appeal but will send you a POPLA code. I think you have a very good chance of winning this at the POPLA appeal stage. Grace periods will be one section to definitely go to town on!

    Have you complained to the landowner? Important route to try straight away.

    They belong to the BPA and this is what the BPA says abut grace periods......

    “No time limit is specified. This is because it might take one person five minutes, but another person 10 minutes depending on various factors, not limited to disability.”

    The BPA’s guidance defines the ‘grace period’ as the time allowed after permitted or paid-for parking has expired but before any kind of enforcement takes place."

    Remind PE about this and suggest they cancel the ticket.
    If they display ignorance then go straight to the BPA with a complaint.

    If you have based your forum username on your real name, you would be wise to get your forum username changed to something very much more anonymous.

    To help with that, you might like to read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:
    Q. How can I change my username?

    A.
    In most circumstances, this is not permitted.

    The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.

    If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.

    So how many minutes/seconds are the scumbags making up that you 'overstayed'?

    You should win this at POPLA stage by explaining the convoluted text message phone registration system and showing your paid-for session proof, that shows you left a minute early, so cannot possibly be penalised for a scam 'overstay'.

    Your POPLA appeal can be copied from other ParkingEye Grace periods POPLA appeals you find when you search the forum for those keywords.

    This should be illegal, but isn't. PLEASE complain to your local MP about this scam.
