tower road popla appeal help

Hello all, I have just received an unsuccessful appeal with parking eye at tower road Newquay, and would like some help with my popla appeal. The charge was for being in the carpark for 15 minutes total. I believe I can argue BPA clause 13 as this is a reasonable amount of time to drive in, not find a space, or other wise, and leave. The signage is not at the entry, so you have to enter to know what contract you are engaging with, but they charge you from the second you enter, not allowing you the right to decide whether or not you want to submit to their contract. Also, as other people have stated the signage isn't clear at the carpark, I have an old image from another poster of the sign but none of my own and i don't know if they've changed. It doesn't state what they use the anpr for on the sign. Also, I think I can claim they did not comply with pofa. I haven't stated who the driver was in my first appeal, and am 90% sure the letter came after the 14 day period, but I no longer have the original letter. I'd like to request a sar to know when exactly they sent it, but is it true this could take a while to come? They said I have 2 weeks before the price raises again and 28 days to submit a popla appeal. Does anyone have any advice of how to beat it and wether or not to request a SAR? Thank you!

The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

Send a SAR now using their privacy page. You should have your PCN by next week or so. Ask specifically for all photos and a 'full copy' of the PCN.
POPLA codes last 32 days, so you need to do the SAR asap and the POPLA appeal can wait a bit for now.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
