ParkingEye charge for using car park twice in 2 days

Wonder if I can get some advice. My father is disabled with a Blue Badge due to mobility issues and a heart complaint. This morning he recieved a letter from ParkingEye claiming that he parked in the car park for 18 hours 41 minutes. This is completley false as we have CCTV footage showing him returning home, receipts from the 2 days, and of course he would be seen on city CCTV as he drops my younger brother off at a train station that has CCTV outside of it every morning. I have tried to phone them but it's just an automatic payment system. I have placed an Appeal online but been told to wait 28 days. I did manage to get through to someone in their office by filling out a form as a business interested in their services. The male i spoke to claimed that they use a "26 point Checking System" to verify their claims.


Any help would be gratefully received!

    This is a very common occurrence, ANPR is only about 93% accurate I am told.

    The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    ParkingEye are in receipt of your recent correspondence in relation to the Parking charge issued at Asda Brighton, Hollingbury car park.

    After a review of the case there is evidence to suggest that the charge was issued incorrectly. In light of this information, we can confirm the charge has been cancelled and you will receive no further correspondence in relation to this matter.

    ParkingEye would like to take this opportunity to apologise for any inconvenience this may have caused, and can confirm that your personal data will be deleted from our systems in accordance with our data retention policy.


    Seems when you tell them you have dashcam footage, home CCTV and an Android Phone that tracks all movements, they suddenly find the missing ANPR clips :rotfl:

    Well, they've accessed your personal data from the DVLA 'without reasonable cause', breaching the DPA in doing so. So why not write to them and ask them for £100 compensation (just the same amount as they would try to charge you for a slight error), you could even offer them a discounted rate of £60 if paid within 14 days (oh the irony!).

    Failure to settle will result in a formal complaint being made to the DVLA.

    I would make the complaint to the BPA, DVLA and MP anyway.

    ANPR accuracy of 93%? In this instance it was 50% accurate at best/worst. It missed two of the four times the vehicle passed the scameras.

    Your Dad needs to get his VRN added to the 'white list' at Hollingbury Asda (I know it well, it's fairly near the Amex!).

    He needs to ask to be exempted on any trip there, from parking charges, due to his Blue Badge - the law (Equality Act 2010) requires Asda and PE to exempt him.

    Actually, I would reply to that email with his VRN and a copy of the BB and demand that PE add him to the Store white list themselves, to stop any disability discrimination by trying to impose the arbitrary time limit on him, a Blue Badge holder with mobility issues and a heart complaint.

    Tell them (in his name) that he consents for, and under the Equality Act, he requires them to retain his VRN for that purpose (white list) only, and also to be added to the White List at the Brighton Marina Asda in case he goes there.

    Let us know what PE say to that? They can certainly exempt him.
