Indigo fine

Hi,

This is my first post and I was wondering if I could get some advice on the above issue. I will try and explain as briefly as possible.

On the 17th December I parked my car at the Train Station in Downham Market, I arrived at about 09:15 to catch the 09:30 train to Kings Cross. I went over to the machine to buy my ticket, everytime I put my reg number in the screen went black and then then went back to the start. I tried this 3 times and then used the cashless parking code advertised on the side of the machine.

I used my debit card to pay the £5.60 for the days parking I required and then shortly after the call ended I got a text asking me to confirm my reg number. I tried 3 times to text the number, but each time got a message stating 'not delivered'. As by this point the train was due I contacted my office and asked them to ring the parking company to let them know I was having issues paying for my parking.

My office (based in Oxford) tried 3 times to contact indigo. The first time they were on hold for an hour, the second time 40 minutes and the third time at about 1pm they got through after another 30 minute wait. Thet explained to Indigo the problem with the machine and the Cashless parking, and Indigo agreed to backdate the parking to 10am and we paid £3.70. The lady from Indigo said that if my original payment had gone through we could claim a refund for the additional fee paid.

When I got back to my car at about 18:30 I discovered that a PCN had been issued at 11:45. I contacted Indigo to appeal my ticket and they rejected based on the fact I was not displaying a valid ticket. I have appealed to the 'Appeals Service' and sent a copy of my bank statement showing the money leaving my account and the receipt from the back dated payment and also the screen shot from the rejected text messages, I just wondered if anyone could give advice on how to proceed

Many Thanks

Railway car parks are different to other private car parks as they are covered by byelaws, so you need to look at other Indigo byelaw railway threads.

Unfortunately you have made about every Newbie mistake in the book by not coming here first. This will time out after six months so you need to use delaying tactics until then.

I just hope you haven't used a paid for appeals service.

What "appeals service" was it? Just ignore it from now on.

I hope you provided evidence and recorded the phone call and proved the transaction. iTAL would need evidence I expect (it is new and questionable in so many ways, so we are watching ITAL with some interest).

Please post with the outcome, and no paying the scam.

If you lose at ITAL, ignore Indigo, but you will know that from the NEWBIES thread, which tells you these fake fines legally time out after 6 months.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Aka ITAL. if you lose ignore them from now on. If you win let us know. You might get debt collectors letters while your appeal is in progress. Let us know if you do.

And you will learn when you read the ITAL thread that it's the same thing. Your case is no different than all the other ITAL Indigo threads.

Please tell us your outcome and decision, from ITAL. We want to learn from them as it's a new twist in the scammery of these fake penalties.

You didn't answer this in your haste to tell me it was AS (aka ITAL):
I hope you provided evidence and recorded the phone call and proved the transaction. iTAL would need evidence I expect
Did you provide evidence to try to win the case?

  • Hi,

Yes I sent a screen shot of my bank statement as evidence of the original payment.

I sent the emailed receipt as evidence of the second payment.

The calls were not recorded but I have the phone records that show the durations

    Thanks

OK, so we need to see decisions by ITAL, to be able to help more people, so please do feed back what they say, word for word, in the decision.

    And no paying!!
