    10 Posts First Anniversary
    i had a parking fine some 5 years and 11 months ago so we are only a month away from 6 years , recently i have been bombarded with letters over last 4 months from dcbl   requesting payment  , and saying my contravention was 2017 when in their original letter it says 2004 May ,   It is stipulating supreme court action , shall i ignore this  its my 4 th letter in as many months

    Start a new thread ONLY if you get a Letter before Claim from DCBLegal (or the parking firm, or another solicitor).

    Obviously (as you are one month away from it being statute barred) in your case, you DO need to respond and ask a few questions and tell them you are 'seeking debt advice but deny any debt' and tell them to put the case on hol and answer your questions...ask for some photos of the signs and ask them if they have evidence of who was driving...anything that ties them up for the required month. 

    The words in bold are vital to include, as they are the magic words to get the case put on hold for 30 days!

     DO NOT mention that the 6 years is nearly up, of course.

  • I've gon a little bit further.  Parking Eye got my personal data from the DVLA to be able to send me their letters.  I have reported them to the ICO for a breach of GDPR.   The ICO have emailed me to confirm they have started an investigation.


    The DCBL letter was actually comical.  On the back of the letter in small print they state that "This case is not subject to High court or bailiff action".  Which means they have got nothing.  I understand they send a maximum of 2 letters and if you ignore them, they then refer the matter back to Parking Eye to see of they want to take the matter further.  In 99.9% of cases Parking Eye do npt take the matter to court despite the fact thy like to highlight the Beav is casein the Supreme Court.  Fact is, if they want to go to court they have to hire a solicitor to appear and fight the case for then but they cannot claim that cost back from you (a matter of law) so they could end up paying £300 for a solicitor to get £100.  (and £100 is the maximum they can get as they are not allowed to add costs to the actual contract consideration ie, £100)  It is simply not financially viable for them.  DCBL are just employing scare tactics to get people to pay up.  Their tel. number to discuss cases is 0203 4030423.  The lowest number in the queue I got was number 20.  Give it a go.  If you press option 1 to pay, you get put through to the automated pay system.  Option 3 to talk to a collections agent will put you in a very long queue.  My phone battery nearly died waiting for a slot.

    Interesting thing is Bailiffs are authorised and regulated by the Ministry of Justice.  I checked on their data bae and DCBL isn't there.  They have a twitter account 
    @DCBL_UK.

    These people are chancers and should be ignored.
