Foolishly I think, I applied to repayment of ppi under Plevin from the Co-op for a loan taken out in 2003. I’ve had a letter from the bank saying that the claim route applies only to charges after 2007.

Can I try again through the more normal route?

Thanks. (Feeling a bit stupid)

You've already tried the "normal" route. Plevin only applies to rejected PPI complaints, so in order to be considered at all, your PPI will have had to be deemed fairly sold. It seems any PPI you had was not mis-sold and Plevin does not apply in your case.
You cannot make repeated complaints I'm afraid.

    Sorry.
  • No. I haven’t tried the normal route. So can I do that now?

    Read my earlier response.
Plevin only applies to rejected PPI complaints. So, to even be considered for Plevin, your PPI needs to have not been mis-sold.

    Sorry.
  • So, are you saying that, because I went direct to Plevin, rightly or wrongly, we have to assume we were not mid-sold, even though I’m pretty sure that wasn’t the case? We hadn’t tried the normal route.

The bank says Plevin only applies to claims on charges after 2007. The loan was in 2003.

So is that an end to it, because I made a mistake and didn’t go down the normal route first?

The bank says Plevin only applies to claims on charges after 2007. The loan was in 2003.

Plevin comes about due to a change in the consumer credit act 2006 (effective 2008, although some falls under 2007). So, if the debt was repaid before the law changed, the debt would never have been subject to that law. Hence the bank is correct in rejecting it.

The "normal" way of doing things is that you make your complaint. If the complaint is rejected, they then look at whether plevin applies. You dont normally go straight to Plevin.

  • I understand that. But I did in error. Does that mean the normal route is now closed? Thanks for your info

How could you "complain" in error?

For the third time, Plevin only applies to rejected PPI complaints, so, in making a Plevin "complaint", your PPI will already have been considered.

What would be your "new" complaint?

You cannot make repeated complaints about the same thing.

It is possible with some lenders to just do a Plevin complaint and not complain about the PPI

The fact remains that Plevin only applies to rejected PPI complaints..

Again, it is not a fact, you can put in a Plevin only complaint without complaining about PPI and actually keep the PPI policy going with some lenders

    Natwest for example
(RBS as part of the same group also accept it)
You can choose to make a complaint only about commission however this will not consider any potential PPI mis-sale. (Commission Only (Plevin) complaint form)

So, in the absence of any categoric rejection of a PPI mis-selling complaint, the OP can try again by this time complaining specifically about the PPI.

He'll need to provide the usual valid complaint reasons, of course.

I still don't fancy his chances, though.
