Cheque bounced but then money taken out many days later

Options
Hi there,

I wonder if anyone can help. We gave a cheque to someone for payment of something. We later had notification from our bank that they payment hadn’t gone through as there wasn’t enough funds at the time it went out. By this point there was enough funds so we withdrew as cash and paid in cash and advised this person the cheque had bounced.

This was a couple of weeks ago but today in our bank the money has gone from our account from that cheque as if it has been presented again – do banks try again once the cheque has failed initially or should that be it? We are confused at how the cheque has now gone through!!

What happened to the cheque? Was it returned to the payee?

My understanding is that banks try to present a cheque up to 3 times before giving up (or did last time I had dealings) although this might just be business accounts.

I think the assumption they make is that you would only issue a cheque if you have sufficient funds to cover the cheque but build in the representing function in case the funds haven't cleared. Both parties did get charged for this privilege.

Your bank have the option of returning a cheque RD (refer to drawer - bounced) or RDPR (refer to drawer, please represent - it has bounced but try again as they might have funds in the near future).

It might be worth your while contacting your bank to explain the situation and complain that it wasn’t made clear.

Hindsight I know but once you then paid by cash you should have stopped the cheque. Normally when a cheque cannot be paid it is posted back to the payee via their bank with a covering letter. The cheque is valid for (I believe) six months.and could be re-presented by the payee at any time during that period.
