service charge dispute

Hi all,

I have a shared ownership property. I pay my service charge monthly via direct debit. Recently I received a demand for additional payment as costs for services was more than the estimated costs. However I noticed that the statement period was April 2017 - April 2018. I purchased and owned the property from 30th June 2017 therefore I emailed the management company asking for the correct amount I owed. They have come back and said that the service charge is issued yearly and that I should speak to my solicitor to see if they had held any money back for this.
Surely I do would not pay for the whole year given that I had nothing to do with the property from April 2018 - end of June 2017. This would be for the previous owner to pay given they were the ones using the services at this point?

  • In short - no, you took on responsibility when buying.

    I have seen advice being given about asking that a solicitor holds a set amount for a period of time in case this happens but not sure whether this is something a solicitor should have advised or whether this is just one of those things you learn through experience.

    Also, consider it the other way, if they decided you had overpaid and sent you a refund would you split it with the seller?
