Removing fraudulant Ccj

I have a ccj that has been recently proven to be from someone opening an account fraudulantly in my name. The debt collection agency have sent me a letter saying they will 'remove the default' from my credit file. I've been googling but I'm a bit confused, do they mean they will remove the ccj or will I have to sort that out myself? And if so how? Do I have to contact the court, or the credit reference agency, or both? Thanks for any help

  • The DCA should contact the court really to ask them to stop,
  • No, do I need to do that to get the ccj removed? I don't know who it was and it happened years ago, I wasn't aware of it until last year when I put my name on the electoral roll and was contacted by debt collectors, i didn't know what it was so I called the original company with the account number asking for more information. A few months later they sent me a later saying they had discovered it to be fraud.

  • if you have been issued with a CCJ , it needs to be set aside and then not be re contested by anyone

    2 ways possible , you pay £255 and give court lot of info , 50/50 you get fee back
    second way UNcontested set aside , fee £100 , if they gave admitted fault , they should pay this

  • the company that took you to court and started court claim resulting in you getting a ccj
  • I agree. Whoever took you to court originally, is ultimately responsible for getting this rectified.

  • if the company that instigated the CCJ have bow accepted that it was incorrect , they need to get it sorted , they cannot with your assistance

    merely "removing a default" will not assist you , that may make it so that bailiffs cannot come round to collect , but the CCJ will be on your record for 6 yrs


    they should give you permission to do an uncontested set aside and indeed they should pay the fees to do this
