You need to get a GOOD WITNESS STATEMENT together.
Point out old reg, date of change, that this was a simple bit of forgetfulness

Your restriction of processing is obviously rubbish. Theyve filed a claim, you cannot stop them procesing. However the SAR SHOUDL should your OLD reg has paid
You can then show that NCP KNEW thatr payment was made
THEY have suffered no loss, certainly not the £!00 they were likely asking, and there was no cause to take this to court - it is de minimis; so trivial a court should not be involved.0 -
So NCP returned the SAR minus the pay machine data, citing gdpr because other peoples information is on there. The guy claims he looked at the data and my old reg was not on there.
Not sure where that really leaves me as I have two witnesses that saw me pay.
In reply to the above i did "keep a copy" but the better half recycled it, for some reason ill never know as she usually never touches my paperwork.
I can get the witness statements no problem at all but my concern now is NCP saying my old reg is not on the data and wont let me see it0 -
You require that the pay machine data IS submitted, IN FULL WITH NO GAPS, with any registration NOT matching your old one Obscured
They are entirely able to do this.

It could be their machine had an error; if you have THREE PEOPEL all stating under penalty of perjury that you DID pay, against NCP being utterly incpaable of contradicting you - they have a negative list, not a postive one - you shoudl be believed.0 -

i will go back to their data protection officer and see what i can jingle out of him, ive just had word back from both friends that they are fully willing to write out a witness statement for me, and even attend if need be (not sure thats a thing in these small kind of hearings?)

yes there is , but no templates as its their own story (and yours as well of course)
so dont expect to find pre-written ones that suit your case, each is bespoke0 -

they should leave the first three characters of each VRM visible
This will enable you to quickly scan for something similar to your old one, while not relasing data about others.
State that if they still object, you will require them to produce this list as evidence anyway, and will state they ahev been unreasonable in delaying its production as CLEARLY it can help narrow the subject under dispute.
Yes, witnesses attend otherwise their statements can be dismissed.

Thank you all that replied, i have contacted their data officer again and will read the other witness statements to see how they should be laid out etc and go from their.0

Just to update NCP sent me the pay machine data, my old reg is clearly sandwiched between my two friends registrations, and i now have 9 signed witness statements backing up my story. The only thing they have now i am lead to believe is breaking their t's and c's i guess. Who knows but im confident i have enough evidence showing i paid for services rendered.
I wouldnt of gotten this far without the help of this forum so for that i am extremely greatful0
