Hi Matty, this was as a part of VW’s assessment of the vehicle and has been provided as evidence of the vehicle not being for for purpose. Not so much spitting my dummy out, just would be nice to have received the lovely car the advert suggested it was. In fairness to the garage they did sell it with a warranty, however the warranty company won’t cover the engine damage due to the race chip. Still, we will await the outcome is & chalk it down to lesson learnt should it go the way MSE forum suggests!0

Really your only hope of getting round the fix offered is to get proof that a racechip could damage an engine, at which point you could argue a fix is no good. In the same way if you found out the mileage was actually a lot higher, clearly there's no "fix" for that. How you could do this would be tricky.
You could start by pointing out a chip will void the manufacturer's warranty, which shows that they clearly don't have much faith in them. So maybe a letter from VW garage stating that they believe these chips can cause permanent damage to the engine might be enough.0 -
Bear in mind that should this go to court action it would be a civil claim. In such cases it's then a matter of who is more believable, as the judge would rule on the Balance of Probabilities. A letter from the manufacturer (or their representative), stating that a "race chip" voids any manufacturer warranty and (in their opinion) is likely to lead to further problems, would likely carry a lot of weight with a judge.0

Hi, thank you for your responses, just to let you all know Visa upheld my complaint and the garage refunded the money in full the day before it went to arbitration. That was back in March and they still haven’t collected the car! Still, Gowan to show if you have the proof you’ve been sold something they’ve not advertised there is something you can do, just don’t get frustrated and follow process.0
