Set Asides - % of court cases

I've crunched a few numbers [albeit for a small sample] and 20% of all daily case listings involving SCUMCOS are for Set Aside hearings.


This is a truly shocking number!!


It implies that either
A: 20% of UK road vehicles are registered to the wrong address and the RK never gets to see court papers before a CCJ is issued against them
B: Scumcos are deliberately targeting cases where they KNOW that the RK address is wrong and they are assured of a default win.

    It implies that either

    Or they've ignored everything, including court papers, and have only realised they've got a problem when they've had a mortgage, loan or credit card application refused.

    info has to be asked for within 14 days ot 56 days ,, please allow 6 weeks for the return of your V5 (if we don't loose it)

    mail redirect has max period of 2 yrs
    court action can be started anytime upto 6 yrs

    Yes, provided it's within that timescale immediately after the judgment.

    But most set asides involving ignored documents are being raised well after the judgment - some many years later. Paying the PPC at that stage won't put right any prior credit rating damage. Knee-jerking to pay is not necessarily the best strategy.

  • isnt it amazing how the likes of gladrags can mysteriously find the correct address shortly after day 31 , but not in the month allowed to pay before active ccj after court case or indeed find the correct address to serve papers to after a lapse of many yrs since incident

    seems to be a failing of "due diligence" , but allowed by guv.uk

    In many cases it is surely the fault of the RK who fails to change their address with the DVLA.
    You never know how far you can go until you go too far.

  • I'm one of these! I had changed my log book when I moved, and DeRP found my new address. BW Legal decided to send the papers to my old address (mail redirect ended in March 2016). PCN was issued in 2015, about 4 months before I moved.

    Surprise CCJ when I was just having a financial nose about on my credit file, as I do periodically.
    Natwest OD - Start: £1,500 Current: £1,500 |  Creation Loan - Start: £2,152.33 Current: £2,082.90  |  Barclaycard CC - Start: £5,242.42 Current: £5,416.45  |  Novuna Loan - Start: £8,598.43 Current: £8,366.04  |  Tesco CC - Start: £9,420.22 Current: £9,885  |  Northridge Car - Start: £15,584 Current: £15,017

    Starting total on 02.07.2024 is: £42,497.40  |  Current total: £42,267.39 (0.5% paid off)

    IIRC the gov has 'is taking action' to ensure claimants do a proper check for a defendants current address [costs them about £2.50iirc] BEFORE issuing papers...but then again this ii the gov we are talking about....so chances are slim imo.
