Parking ticket, threatened with court, urgently need advise

Hello,

I was hoping someone could help me in what to do next.

I received a parking fine for £60, I appealed this as I had a valid parking permit and believe it had fallen off the dashboard, I didnt hear back from the UKPC so assumed case was closed.

I then started receiving messages from debt recovery threatening court. I called UKPC, they said they sent a letter informing that the fine was reduced to £15 but its too late to pay now and to contact royal mail if I did not receive this letter. I asked for a POPLA number but this has now expired.

I am not sure where to go from here, do I have to pay? Any help would be greatly appreciated.

    Is there nothing that I can do now? I am worried about the fine increasing further or having a bad credit rating.

    Read the NEWBIE sticky regarding debt collectors. They cannot take you to court. You will only have a bad credit rating (whatever that is) if you go to court, lose and fail to pay any CCJ within one month of its issue.

    The largest amount of money I've seen reported here in relation to unsuccessful court cases is about £225. But, the very experienced regulars reckon that 99% of cases are successful if people follow the procedures recommended here carefully.

    You may well get letters from dodgy solicitors and debt collectors threatening all sorts of things, including bailiffs and damaged to credit rating. But neither of those things happen. The parking companies lie. Yep, they truly are scammers.

    The only way your credit rating would be affected is in the unlikely event that this was lost at court, if that happens then paying up is required.

    Read through some posts and the Newbies' thread to get a fuller picture of how you can fight this, how things may pan out and the wonderful help & advice available to you here.

    What were the circumstances? It could be that a landowner complaint is in order - that's a great way to make the problem go away. If you come back with more details, do not reveal the driver's identity.

    In fact the whole industry is a scam, relying on threats of court, and the public's ignorance of the Law,

    A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.

    BTW, it is not a fine, it is an invoice for damages for alleged breach of an alleged contract.

    I bet they aren't saying that at all. They will say it may go to court. Usually they say they will recommend to their client that court action is taken.

    Very, very different.

    You take no notice of DRP as they are money scamming morons who can do nothing let alone take you to court and damaging your credit rating.

    Get your head round this, it is not a fine, it is an invoice for damages which they allege you caused them for allegedly breaching an alleged contract. In other words a scam. Have you complained to your MP yet?
