Received PCN from CPM in post despite having a permit

I have a visitor's parking permit allowing me to park on a private road. The picture in the letter is taken from about 10m meters away and the parking permit is not visible from that angle/distance but certainly visible if the photo was taken up close.

Looking through the newbie thread, I am unsure if I should use the template appeal for BPA/IPC or whether I should simply state that there was a valid permit and upload a picture or my permit.

Should I still use the template and slightly reword it stating that a valid permit was on display?

Nothing you put in the initial appeal will make any difference. It will be rejected.

You can add the other stuff if you want, but don't expect it to make any difference.

The only place this will be beaten is in court.

Take a picture of the vehicle with the permit in it's normal position taken from the exact spot where the scammers took theirs. See if they squatted down or used a certain angle to hide the fact the permit was there.
Use whatever angle they used, then stand normally if they have "fudged" things and see if the permit can actually be seen from the same distance.
Take close ups as well.

What does the lease/AST of the person the driver was visiting say, or not say about parking and parking permits? This will have primacy of contract over anything the scammers say.

Get pics of the site and signs as well.

Please also complain to your MP about this unregulated scam.

The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
