ESA successful reconsideration but still lose

    Put details of the MR notice on your journal, tell your work coach, and ring UC.
    The system is so poor that there is a manual intervention needed between ESA and UC staff to effect this additional payment, so it will take a while.
    Keep pestering them!



    I would definitely contact your MP about the loss of your SDP (and the incorrect advice about having to claim UC), I would also write to the DWP to ask about their intention (following the high court case) to provide compensation for people in your situation (so you are on their radar) .

    I think (but am not sure) that the LCWRA element should be backdated. I suggest you check this with your local CAB / advice agency. Don't take as gospel what you are told by badly trained DWP employees.

    I put it on the journal on Monday but have had no response, so I took your advice and rang them. The adviser was really snotty saying I should have brought the MR letter in so I told her that ESA had emailed it over on 15th Jan and she said they were too busy to look at the emails so I have to take it in to the job centre. She also said it's only Thursday so it's not that long waiting for a response from the journal.

    I'll go down tomorrow and let them copy but I'll phone My local CAB too.

    Update!
    So I went to jobcentre with my letter saying I was successful and they uploaded (they really slagged off UC) but still couldn't do anything.
    So last week, I went to the CAB with all my documents and they said they'd not seen this before (how?) and said they couldn't advise anything as it's too early and I need to wait to see if my next payment from UC includes the payments similar to UC but I locked on the journal today and my next payment is still going to be the basic job seeker type amount.
    I just don't know where to turn to now, Maybe I'm jumping the gun but I thought that with UC having the info from ESA 3 weeks ago, they might let me know what's going on.

  • this really is not acceptable, how they can roll out a system for a few years now and advisers both DWP and CAB do not know the system correctly

    A businness could never operate like this

    it needs somebody to completely stop it and sort out the people that have the misfortune who claim it

    hope you get to the bottom of this

  • Interesting. I scored 0 points on my ESA reconsideration, and on their advice, started my claim for UC. I went to the identity checking interview.

    The next interview I was so stressed I walked out halfway through, then contacted them via my UC login page to say I'm stopping my claim for UC.

    The claim procedure never got completed, only started.

    On the extremely small off chance I win my tribunal, does that mean as I started my UC claim, I cant go back to the ESA support group?
    The way things are going, soon we are all going to be victims of something or other.

    Who will we blame then?

    If you gave them your ID then your UC claim may have been completed, if so then no you won't be able to go back onto ESA.

    Duh that's the whole point of a proof of posting.

    Once received by Royal Mail and accepted into there system and proof of this has been obtained i.e. at the post office etc, then it has to have been received by the recipient.
