The babyroom.co.uk 15% restocking fee - is this allowed?!

I'm returning something to thebabyroom.co.uk and they said there's a 15% restocking fee - so by sending it back I'm giving them 15% of the price for an unused item plus I pay postage...is this legal?

    Nope, however
    A deduction can be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary.
    The extent to which you can handle the goods is the same as it would be if you were assessing them in a shop.

    Their T&C's make for some interesting reading (https://www.thebabyroom.co.uk/Terms-and-Conditions). I gave up counting their attempts to remove statutory rights/disclaim liability they can't disclaim, as there was so many.

    I wouldn't touch them with someone else's bargepole, nevermind my own!

    OP, how did you pay for the order and how much were the items?

    What are you returning, why and how long after delivery?

    Some terms are unlawful, however the restocking fee is valid if you're more than 14 days from delivery. They will accept some returns up to 28 days after delivery and can apply any terms they like to these.

    Only if they informed you of your rights in accordance with the CCRs. If they didn't then the cancellation period is extended up to 1 year and 14 days - which would mean their T&C's are still trying to remove your statutory rights.

  • I bought a bouncer on the 1st Jan for £129.98. I paid by PayPal. I'm returning it as it's unsuitable (my baby was premature and he's too small for it). Do you think I should refuse to pay the 15% fee? Really regretting not checking the t&c's!!

    Have you unwrapped it at all? Taken it out the box?

    If you haven't unwrapped it at all , then do not accept any restocking fee.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Would you consider keeping the bouncer until your baby is big enough for it?
    That may be the easiest way forward especially if you do have to pay the return costs.
