    She is going to go into the council tomorrow with the agreement between her and her daughters ex (he is living elsewhere) so hopefully that will get the housing benefit reinstated.

    Unfortunately an agreement with a son-in-law is likely to be classed as a close family relationship, even if daughter and husband are separated. (Especially if the house was the marital home, the daughter is on the mortgage, and the property was not previously commercially rented).
    The council will need to be persuaded that a commercial agreement exists - that could be difficult in the circumstances you describe.
