co freeholder selling

I have had a very acrimonious relationship with the couple I share the freehold of my flat with. I began extending the lease of my property(with their consent) last October, four weeks later they told me they had a buyer for their flat. My extension is in jeopardy which I would like to talk to the buyer about. My Co Freeholders have refused to tell me what disclosures they have made (they have complained about me 8 times to police), I have asked for buyers details so I can discuss all the above, two remaining disputes, and the joint buildings insurance we will need to have. A letter I sent via the Estate Agent has been returned and I am TOLD the joint insurance we currently have will be transferred and they will take legal action If I don't sign the TR1 tomorrow.

    You plus this other couple each own the leasehold of your respective flats.
    Are these the only two flats in the building?

    You plus this other couple each own 50% of the freehold of the building? TiC or JT - or do you each own 50% of the shares in a company which owns the freehold? There's no other joint freeholders?



    Is this other couple selling the freehold to their leasehold buyer, or keeping it?

    Why is your lease extension in jeopardy, given that you are 50% freeholder, and the other 50% has consented?

    What do these "disclosures" and the police have to do with the freehold sale or extension?

    But there's clearly more to the history, and the story, than this (8 complaints about you to the police......?).

    Putting that aside, and given the poor relationship with your current joint freeholder, surely the good news is that they are selling? Wait till the new owner is in place and start afresh - with tea and cake as a starter!

    Our property is a house converted into two flats with lease plus share of freehold. Too much to go into but basically, they began an Airbnb (restricted in our lease and joint building ins), I put a stop to it, they said I had stolen their house keys went to police and got nowhere. Then complained 8 times to police I was harassing them, and I had to speak to police about this. Of course nothing to with police, civil matter but felt vulnerable to other such claims and don't live there permanently as a result.


    Reciprocal agreement to extend lease, they have done theirs I am in the process of doing mine (I got further written consent from them just before starting) then told they had sold property. I was not aware it was up for sale bit fed up about this and might need to complete this with new buyer. I want to contact them, I have also asked for two months to see disclosures re neighbour disputes and have been ignored. I was threatened with legal again regarding TR1 so I wrote to buyer via the Estate Agent documenting disputes, two repairs the sellers don't look like they will honour, and suggesting we instruct a management company. This was returned to me, I am told I have until tomorrow to return TR1 and the joint buildings insurance will be transferred into this new person's name. I suspect they have played down our disputes and are trying to bully me into signing. I want transparency moving forward, surely I have the right to contact the new freeholder?

    And quite right, too. Why do you want to see this, and what's it got to do with the price of fish?

    I suspect they have played down our disputes
    If these neighbours are the problem, then don't you want them to move, so you can start afresh with new neighbours? Or what...?

    You really need to separate your personal issues with your soon-to-be-ex-neighbours from your lease extension.

    Your lease extension should be ready to sign so say, yes, we can sign the TR1 and my lease extension tomorrow.
  • There are huge problems with the property and the last seller told a pack of lies and sold cheap and quick to the current owners then disappeared.. Seriously I could write a book, I've had five years of that is nothing to with us take it up with xxx, they have pretty much taken their frustration out on me. Regarding this sale I think they are attempting to do the same and I am determind to ensure all disclosures are made this time when there are lawyers on both sides to sort it out. I have written to the buyer asking to discuss matters arising (advice from lawyer) but they have refused to pass it on.

    My question really is can I be denied communication with a buyer for a flat that I have the share of freehold with? The Agent will not forward my details I am not being given lawyers name and I have a terrible sense of here we go again.

    Of course not. When they move in, you simply go and knock on their door.

    You need legal advice about

    * whether/how you can be forced to sign the TR1,
    * whether you have a right to communicate with the other party to the TR1
    * whether/in what circumstances you can refuse to sign the TR1


    Certainly you can delay this, thereby delaying the sale, and that may be enough to pursuade completion of the lease extension.


    But in the longer term, it still seems to be in your interests to get the sale completed and get rid of your annoying joint freeholder.

    Who has completed and signed the LPE1 form at the enquiries stage? This is where the Freeholder should have declared any issues with the conduct of the Lease.

    I suspect your solicitor would advise you not to sign a TR1 until you have had visibility and are satisfied with the content of the LPE1.
  • Thank you and yes spoke to a lawyer today, sellers lawyer unaware of dispute Lpe1 completed by them or should I say not completed.
