Euro Car Parks Notice to Keeper
Fisherman9
I am the registered keeper of a leased company car and due to family/health problems I have missed the 28 days deadline to appeal to POPLA by 5 days. The incorrect company name is stated on the letter and emails,, please could you tell me if is this grounds for appeal even after the 28 day deadline.

PoPLA codes last for about 32 days. It's worth trying to fire one in now just in case it is still valid.
It will depend how far off the company name is. If it is just mis-spelled, then it's irrelevant. If it's for a completely different company then it will make a big difference.
Template PoPLA appeal points can be found in post 3 of the NEWBIES. Major appeal points for hire/lease cars is if the scammers have not provided a copy of the lease/hire agreement and thus failed the strict requirements of the PoFA 2012.
If the appeal is out of time and the system won't accept it, then contact the scammers telling them they must provide a new code in accordance with the ADR Act 2015 that states access to an independent appeals service must be available for not less than one ear.
Point out any failures to meet the PoFA requirements to the scammers that you would otherwise have made to PoPLA.I married my cousin. I had to...I don't have a sister.

Thank you very much, the code is still active, I will look at post 3 now.0

I have looked at post 3 but cannot find an appropriate template. I will use the point that they have not provided a copy of the contract hire agreement and that the company name is not my company. Do you know if there is a template for contract hire vehicles?0
-
Post 3 of the NEWBIES has a number of template appeal points including but not limited to,
Not the landowner
No standing to issue charges
Non PoFA compliant NTK
Inadequate signage
Grace Periods
Etcetera
Use ALL points that apply. Not supplying the hire/lease agreement is only one point (non PoFA compliant NTK.)
You will need to look at the PoFA (linked from post 1 of the NEWBIES or use a search engine of your choice) and compare the NTK with the relevant part of the PoFA Schedule 4 relating to hire/lease vehicles. (Para 13 I think)
Point out each and every failure to meet the very strict requirements of the PoFA.
Paras 13 (2) a, b, and c, and (3) are the ones where they have likely failed.I married my cousin. I had to...I don't have a sister.

On the NTK it states that they do not know the driver's name or current postal address and that i should tell them the name & current postal address of the driver and pass it on to them and that if I don't they have the right to pass the charge onto me. Is this right?0

Naming the driver would be completely and utterly stupid, and likely hand them a PoPLA win on a plate. That's why they are asking
At the moment the keeper is holding a winning hand because the scammers have failed to comply with the strict requirements of the PoFA.
Please follow the advice you have been given whilst your PoPLA code is still valid.I married my cousin. I had to...I don't have a sister.

I hope you put in all the points I mentioned earlier that are relevant, and quoted each part of the PoFA paras 13 and 14 where the scammers failed to comply as well.
Unfortunately PoPLA assessors need things spelled out in simple terms.
I should have suggested that you post your draft here for checking, but appreciate you were pushed for time.
I'm glad you got it in in time anyway.
You may get an opportunity to rebut the scammers evidence during the appeal process, so keep a regular eye on your junk folder.
Please let us know how you get on, but remember that the decision is not binding on the motorist.I married my cousin. I had to...I don't have a sister.

I hope it was like this well-researched hirer one:

100% win awaits a hirer appellant who never says who was driving, and points out to POPLA, the facts about lack of documents enclosed with the NTH.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
