Housing Benefits Help!!

[FONT=&quot]Does anyone know if there is any help with Housing Benefits? In a legal sense.[/FONT]

[FONT=&quot]I'll try and keep it short, in July 2016 my DLA stopped as I had a failed PIP claim. We were awaiting an appeal which was successful on 21 December 2016 and in February all monies owed were back dated. All except Housing Benefit who told me to submit another claim form.[/FONT]
[FONT=&quot]We duly did that and on 17 April 2017 they sent the benefit calculation which showed us to be earning double what we actually were and therefore not entitled to full benefit.[/FONT]

[FONT=&quot]We immediately wrote to them regarding the error but didn’t receive a reply until 30 May 2017.[/FONT]

[FONT=&quot]The situation is still on going only now they are saying as I am outside of the appeal deadline there is nothing they can do and we are under threat of losing our home.[/FONT]

    Why did your housing benefit stop? PIP isn't means tested and won't affect any housing benefit you're entitled to.


    Do you work? You say "we" do you live with a partner that works?

    What did you do when you received the May 2017 letter?
    Did you challenge this with the council?

    There is a 13 month deadline for appeals. Do you have a decision notice within that 13 months deadline that you can appeal.

    I would suggest you:
    a) Contact Shelter - https://england.shelter.org.uk/get_help
    b) get your local councillor involved with your dispute.

    Unless there was SDP or carer premium involved. As you say more information is needed to understand what the benefits issue is. Could also be related to whether deductions for non-dependants are applicable.

    OP, you say you had a reply in May 2017 - what has happened since then? You can request an ‘any time’ review but you’re going to need a strong argument toersuade the council to accept this.

    Can you get help from a local CAB?

    What i meant by that is, PIP isn't classed as income, which is why i said it's not means tested. The OP states the calculation showed them as earning double the amount.

    Sorry if you read my post as a criticism of yours - not intended as such. It was just that I thought it's possible that there may be more to it than OP's post suggests. You know how information can get dribbled out during these threads!
