Buying rented house with Vacant possession

Hi there,

I am currently in the process of purchasing the property I am renting. The ventor has served me notice and my tenancy agreement is due to end in 2 weeks time, as he requires ‘Vacant Possession’ of the property.

Does anyone have any advice on a tenant buying the property they’re renting and how it works in relation to vacant possession. It seems insane for me to pack the whole house up, put it into storage, only to return it to the same home I moved out of!

Surely there is a way around this?

Any advice would be much appreciated

    Yes, it would be insane. No need for you to move out. Get the lawyers to sort it out between them.

    What's the timescale for exchange and completion?

    Legally, vacant possession has to be given. But notice is one thing, actually physically moving all your stuff out is another entirely.

    I think it's implied that it means "vacant of everyone whose presence might prejudice the purchaser". If it's already occupied by the purchaser that's hardly a problem.

    Only if the contract says so. Get the solicitors to remove the vacant possession clause...
