Parking Eye Airport Pub Manchester

Hi,
I have read the NEWBIES post and some of the general advice however not being the best on computers my head is crammed already with what i need to do so please help.
Circumstances
The driver attended the Airport Pub last year in november, the driver saw that there was ANPR cameras and a ticket machine. After parking up the driver immediately went to the ticket machine, entered the car reg and put the debit card and pin in to pay. Once it was processed no ticket came out. The driver then looked at other cars in the car park and saw no other cars had tickets so presumed it was all done electronically via ANPR.
When entering the Pub the driver asked staff if the machine would give a ticket to which pub staff replied "its all ANPR".
The driver then had a meal in the pub and overheard other customers asking staff the same question with the same response.
A PCN has been received in January 2019 after parking eye made enquries through the credit reference agency for the drivers address as the vehicle was not yet registered to a new address.
It seems unfair when all steps were taken by checking other cars & speaking with staff to think that the fee had been paid. On checking bank statements no fee was taken by parking eye for parking at the pub in november.
Please help with what is the best course of action..

Luckily, this will be a Golden ticket then!A PCN has been received in January 2019 after parking eye made enquries through the credit reference agency for the drivers address as the vehicle was not yet registered to a new address.
Search the forum for those words and the image shown in the NEWBIES thread post #3, shows you what the back of a Golden ticket PCN looks like. Compare yours!
Or have PE not sent a PCN, but instead a tracing letter, which also offers appeal?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The PCN states date issued 21/11/18 and the letter re how they got my details was sent 16/01/19.0

Well it's way out of the 14 day window for ANPR tickets, so it fails POFA. Don't admit driver and use Golden Ticket appeal.

You didn't send me the NtK within the POFA window so keeper liability does not apply.
Cancel ticket or send me POPLA code.

Just to clarify, Parking eye issued the PCN within the 14days however this went to an old address. They have since found my new address via credit checks and issued the letter to me 16/01/19 with a copy of the PCN from november.0

So do you mean you haven't updated your car's address at the DVLA? Updating a driving licence is not the same thing, so prioritise that.
And email PE a SAR using their privacy page form. Attach the V5C as ID.
Ask them for the machine records of failed payments, and partially completed transactions which must be recorded and must include your VRN or a close match. Explain that a card payment was made using a debit card from xxxx Bank and the PIN was entered so this cannot be something the machine does not record, even if the system then failed.
And meanwhile complain to the landowner/retailers to cancel it quickly.

I spoke to the land owner and they have stopped using ParkingEye due to the amount of problems they caused for customers. Apparently it took months to get the machines working and then when the machines were installed they would often give out a ticket which said in small print "transaction void".
The land owner refused to cancel the ticket as they do not want further contact with Parkeye "we left them on bad terms"
I've clicked on the appeals on ParkingEye website and my reference now states cancelled, balanced owed £0.00. Hurrahhhhh!

Now complain to your MP as they have wasted your time.
The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0
