Proof of parking ticket purchased

Hi

I've received a PCN from a visit to a car park where I can remember categorically that I purchased a ticket. However the parking company are saying my registration was not entered into their system and therefore I am liable for the charge. They claim no similar registration was entered and there was no faults with their system on that day.

I do not have the parking ticket in question but I am livid at the thought of having to pay them for what is a false claim on their behalf.

Wondering what my options are in terms of asking for further evidence from the company? They have supplied what looks like screenshots from video of my visit so they may well have footage that proves I purchased a ticket.

Thanks

    Hi... I am livid

It's hard to get your head around all this while livid! Fact is, the private parking companies do outrageous things and they don't care.

Check out the newbies' thread and then come back once you've calmed down if you are still not clear about what you should do.

    (I sympathise though!)

Google for their privacy page and send them a SAR (NEWBIES thread post #2):

Ask specifically for the VRN list from the machine, an hour or so either side of the visit, and to partially redact all other VRNs but lease sufficient partial data for you to see your payment which WAS made and thre must be a partial VRN there.

If you also use another car, give them that VRN as well and ask the DPO to look for that VRN too, in case the driver input the wrong car out of the two.

Also ask for all other data held about you/the car that day, including all photos.

Attach the V5C as ID for the car(s) to show you are the data subject entitled to the data.

You are now a victim of the GREAT PARKING TICKET SCAM.

It is the will of Parliament that these scammers, (very often former clampers), be put out of business.

Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
You never know how far you can go until you go too far.

So I've received the VRN info back from the parking company and it does not look like my reg number or a variant such as one figure out is on there.

I am sure a ticket was purchased so I can only assume either their machine was faulty (they claim not) or someone had entered their details but not paid for parking- meaning I paid but it was not put against my reg.

They are claiming there is no further film or images of the incident apart from two standard reg plate shots arriving and leaving.

Any advice on what to do next?

Nb. There are several 'nonesense' reg entries in the record around the time of the incident so it seems possible that one of these might be one I inadvertently paid for. Any idea on how to pursue this? Surely they must be able to cross reference other registrations and confirm if there was a vehicle with that reg, or whether that is 'my' reg?

Bank Park are (or have been) a member of the IPC, where beyond your initial appeal, no further action is recommended until such time a LBC or MCOL Claim is received.

I've just checked the IPC list of AOS members and Bank Park are no longer showing as members.

    https://theipc.info/aos-members

So, contact the IPC and enquire as to their current membership status. If they are no longer members (or are suspended) get hold of the date their membership status changed. Beyond that date they can no longer access the DVLA database for keeper data. If your parking event is after that date, the PPC could well be in trouble.

But there may well be a very logical reason the name isn't showing on the IPC list. Don't get overexcited!

Come back and tell us the outcome of your enquiry.
