Completion fallen through - where do we stand?

    Yes, you can go for all of your costs from the people ahead of you in the chain.

    Yes.
    I would ignore the comment about claiming higher costs than you need to I.e. going to a hotel when you don’t need to.
    You have a duty to mitigate losses (which you have done).

    You probably can’t claim anything for staying with family as you haven’t incurred a financial loss, nor I suspect for self-catering (which would cost the same as normal) but you would be able to claim extra travel and your extra removal costs.

    For future reference (and others reading) don’t complete on a Friday.
    If this happened in the week you’d still have the same issue but it would be 1 night and not 3 nights.

    We ofiginally said we wanted to avoid Friday but these solicitors and estate agents said completion will have to happen on a Friday, I just can't believe the situation we are in. I've hardly slept all night. I'm now sat thinking "what else can go wrong on Monday". I mean all the funds have been passed through but too late as the last payment was received at 5:05. Does that mean we will definately move on Monday? Or could something else now crop up

    So all the money has definitely been transferred around now, and all received by everybody everywhere?

    Then you're in the drawn-out throes of completion right now! Keys could easily be swapped around now, but it's probably safest to wait until Monday.

    The only thing that could really go wrong now is for somebody removal to play up on Monday.

    Yeah the issue was that the people in front of us received the money at 5:05 my solicitor said however they couldn't contact the solicitor above as they had all gone home and it was "too late". Does this mean we will definately move Monday if all funds have been received? Or could some other !!!! up occur with th being awkward? When all funds have been received is the house "ours"? The removal people have been brilliant and said they will take our stuff to the new house when we get they keys Monday. This has been stressful from start to finish with solicitors messing about but we did not expect this to happen on completion day!

    Whilst this is obviously stressful, just take comfort in knowing that these things can and do happen. It's unfortunate the solicitors representing your sellers did not wait a while longer if they were made aware the money has been sent across, but that's done now.

    How did you get confirmation that the money had arrived in their account at 17:05, if they were no longer there?

    As long as the money is there, the keys should be ready for you to collect first thing Monday morning. So try and enjoy the weekend, move in on Monday, get settled, and then you can have a conversation with your solicitor about recovering any losses you have incurred - which you WILL be entitled to, so do not worry.

    Our solicitor must have received confirmation somehow - I don't know they get an acknowledgement that the money has been received automatically? Either way it's just been so stressful and I just hope nothing else goes wrong now on Monday. I've spoken to the estate agents for the property we are buying and they said as soon as receive confirmation Monday morning that the money has been received they will give us the keys

    I cannot believe that everyone in the office goes home at 5 on the dot and switches their mobile off in this situation.

    I think it really depends what /who/type you use.

    My solicitor has replied to me at 9.00 at night and 7.00 in the morning and my EA never stops calling even after completion, mind you he is a friend :j
