UKPC POPLA appeal Julian's carpark Didcot

Dear Forum members,

I hope that you can help me!

On 30 October my car was parked at Julian's carpark opposite Didcot Parkway station. I was in the car but was not driving it. This carpark is operated by UKPC and payment is only possible via the RingGo app.

I use this carpark regularly, usally without any problems. On this day though, for some reason the app made the payment not to the Julian's carpark location number, but to another carpark's number, this other carpark is directly adjacent to Julian's (there is only a small fence separating the two). We were in a hurry and never had this problem before, so didn't check the confirmation message that closely and got a nasty shock when we got back.

So I followed the advice on the Newbie thread although I think I got some of the timings wrong. I appealed to UKPC as the registered keeper of the vehicle on 1st December and shortly after received the NTK dated 30 November. On 3 January I received a letter rejecting my appeal and giving me a POPLA reference number.

Do you guys think that I have any chance? And is there a template somewhere for the POPLA appeals? I searched the forum but couldn't find one. I am not sure how to word the appeal.

Additionally, I've seen other threads regarding this carpark where the appeal was on the grounds that the signage is not adequate. Would it be better for me to go down this route?

    If the do not claim a debt is due, then they can refuse payment by means they dont wish
    If they claim a debt IS due, for example pay on exit, then refusing legal tender should be a problem for them.

    Did you reveal the driver's identity in your appeal to the scammers like you have done in your opening post here?

    If not, edit your post to remove information about who parked. Only ever refer to The Driver and The Keeper.

    Use ALL the relevant appeal points available to you from post 3 of the NEWBIES at PoPLA.

    I have yet to see a UKPC sign that meets the BPA CoP requirements so Inadequate Signage should appear prominently in your appeal.

    Just word the POPLA appeal saying you were an occupant of the car but the driver has never been identified (unless you actually ticked 'driver' on the dropdown appeal menu? Surely not!).

    Include proof that this is a railway car park and lots of photos of the lack of definition and clarity between the two car parks, such that 'the occupants of the car' relied on paying for the railway car park as usual (show proof) and had no idea these were meant to be two different ones.

    Then a point about railway car parks not being relevant land, therefore UKPC can't hold a rk liable (despite serving a NTK) as that right does not exist on railway land as it is subject to railway byelaws.

    Then the usual POPLA template stuff from the NEWBIES thread.

    It's a private car park, not on railway land but opposite the station, if that makes any difference.

    Ah OK, so you can only use a couple of the templates from the NEWBIES thread post #3.

    You could try another sneaky one, given these facts (DO NOT SAY THIS TO POPLA):

    How about stating that the driver did pay for the right car park and was parked in the right section, and embed a screenprint of the payment made and put UKPC to proof to the alternative.

    It makes it hard for them if the 2 car parks are next to each other...how will they prove to POPLA that the payment was for the wrong car park? Worth a try I think, albeit write it from scratch for that point.
